ORDER
Per: SURESH KUMAR BATRA MEMBER (J):-
1. The applicants in the above captioned 124 Original Applications,, who are the regular employees (PRT/TGT/PGT) of Kendriya Vidyalaya Sangathan, are aggrieved against the transfer and relieving order dated 12.09.2022/13.09.2022/16.09.2022 respectively issued by the Kendriya Vidyalaya Sangathan (HQ) New Delhi. By way of these Original Applications, they have sought quashing of these transfer orders.
2. The relief claimed, the facts, the grounds and the legal issues contained in the aforesaid OAs are common, therefore, these Original Applications are being disposed of by a common order with the consent of learned counsels for both sides. For the sake of convenience, the Original Application No. 860/2022 titled Sangeeta Rani Vs. Union of India & Others is taken as a leading case for briefing the facts.
3. The applicant joined Kendriya Vidyalaya Sangathan as PGT (Economics) on 11.02.1994. She was posted at KV Subathu, H.P. from where she was posted on 26.07.1995 to K.V. II Chandimandir and on 03.10.2000 she was transferred to KV II, PLW, Patiala, where she is working as such till date. The respondent No.3 issued a common order dated 12.09.2022 (Annexure A-1) of mass transfer of teachers consisting of transfer of 193 individual randomly. The applicant has been ordered to be transferred from KV II, PLW, Patiala to KVS, Bhadrak, Orissa. The respondent authorities at Delhi issued an administrative 63- O.A. No. 860/2022 and connected matters order dated 13.09.2022 (Annexure A-7) to all the Principals of KVS in Delhi that they should immediately relieve the employees, who have been transferred by virtue of order dated 12.09.2022 and no representation from such employees should be entertained or forwarded. Irrespective of the above development the applicant still has submitted representation on 13.09.2022 through e-mail (Annexure A-8) to the authorities, while highlighting various grounds on merits for consideration which has been rejected vide order dated 20.12.2022 (Annexure A-10) without considering her pleas raised on merits.
4. The applicant has contended that the impugned order is illegal, arbitrary, discriminatory, malafide, harsh, void ab initio, null & void, in violation of the transfer policy as well as DOP&T O.M. on spouse unification, law on the subject on the following grounds.

It has been submitted that the Kendriya Vidyalaya Sangathan framed transfer guidelines for transfer of its employees including the teachers from time to time and lastly the guidelines were framed in year 2021 namely "Transfer Guidelines of Kendriya Vidyalaya Sangathan 2021" (Annexure A-4). Till the passing of the impugned order of transfer on 12.09.2022, as per the past practice and precedent, Respondent No. 1 - the KVS Sangathan used to initiate transfer drive for each academic year annually and the employees including the teachers used to participate in the same by giving their five choice stations in case they are in the line of transfer in terms of prevalent Transfer Policy.
Notwithstanding the power vested in the respondent authorities the cases of transfers in respect of person suffering from chronic disease‟s/ persons whose children were in class 10th and 12th/ persons, whose spouse or child is suffering from serious ailment/PHD 64- O.A. No. 860/2022 and connected matters category/employees falling in spouse category etc. used to be accommodated and exempted from transfer as far as possible.
However, this time an exception has been carved out for the first time while effecting the transfer under the Transfer Guidelines of year 2021, where under directly transfer order qua 193 employees has been passed in total breach of the policy, consideration in cases covered under the policy guidelines as well as DOP&T O.M.s. The displacement counts have been thrown to winds, which are the basic and requisite criteria for posting out an individual and the same has been devised to wipe out pick and choose, arbitrary actions etc. No hearing, whatsoever has been given, no opportunity has been given to offer any choice station to apprise the authorities of any specific grounds available to a Teacher, who is being transferred out.
6. It has been further contended that the „Transfer Policy 2021‟ has been given a go bye by official respondents so far as it relates to displacement counts. The impugned order is violative of Clauses 6, 7 and 9 of the Transfer Policy, 2021. It has also been contended that the mass transfer order is a routine order, neither disclosing nor having been passed under any administrative exigency or in public interest.
The transfer order has been passed without according any consideration to anyone, who is named in the order irrespective of the extenuating circumstances from which the individual is suffering or is covered. The transfer has been made a via media to fill vacancies rather than filling the vacancies by carrying out recruitment as respondents admitted that to overcome the short fall i.e. to maintain 50% strength in another Vidyalaya the transfer has been effected. This is illogical and absurd and has no logic or nexus with object sought to be achieved as by shifting a 65- O.A. No. 860/2022 and connected matters teacher of one subject from one vidyalaya and when no one is transferred in place of that teacher and such an exercise cannot be in the interest of students or Institution or even Public.

The further contention of the applicant is that the order dated 12.09.2022 is violative of Clauses 6, 7 and 9 of Transfer policy 2021 and it is also violative of DOP&T Office Memorandum F.No.28034/9/2009- Estt.(A) dated 30.09.2009 (Annexure A-6) which has been issued by the Nodal Ministry to ensure spouse unification in case of working spouses by the cadre controlling authority, who should strive to post the employee at the station of the spouse and in case of inability to do so, specific reasons, therefore, may be communicated to the employee.

2. Applicant has the liability of her husband aged about 59 years suffering from medical conditions severe Diabetes (on insulin) with multiple medical complications. He needs regular supervision and care. Because of his health conditions, he is not working and applicant‟s job is the only source of income. Applicant‟s daughter is of marriageable age (27 years).
10. The respondents no. 2 to 4 have filed short reply followed by a detailed written statement contesting the claim of the applicants and justifying the transfer order(s) passed by the respondent no. 3. It has been stated that the transfer of the applicants is necessitated in the interest of the organization. The transfer guidelines itself provides for the objective that it shall strive to maintain equitable distribution of its employees across all locations to ensure efficient functioning of the organization and optimize job satisfaction amongst employees. All employees are liable to be transferred anywhere in India at any point of time and transfer to a desired location cannot be claimed as a matter of right and that while effecting transfers the organizational interest shall be given uppermost consideration and the problems and constraints of the employees shall be subservient. It has been submitted that in the light of this objective, the policy to transfer certain employees including the applicant have been effected for the following reasons:-
(i) That it has been documented that due to disruption in normal schooling for past two years owing to the pandemic situation, there has been significant learning loss amongst students. Many children have had difficulty with 80- O.A. No. 860/2022 and connected matters online/ blended mode of teaching. The NAS 2021 data for classes III, V, VIII, X also corroborates the same.
According to the Mental Health and Well-being of School Students, 2022 report published by NCERT, in the Chapter relating to KVS, it has been stated that during COVID-19, as classes were taking place in online mode, 54% of the students, who participated in the survey reported facing difficulties in understanding and learning of content through online mode. Teaching-learning happens best in face-to-face mode through a teacher. Hence the need was felt to address on priority, the learning challenges being faced by the students for the past two years due to pandemic through administrative means. The rationalization of teachers & redistribution of the existing teaching staff have been effected to address the above core challenges after the pandemic, so that at least 50% of regular teaching staff (inclusive of all cadres) are available in all KVs.
(ii) That Teachers in Kendriya Vidyalaya are recruited on all India basis and have all India transfer liability. Accordingly, all employees of KVS are liable to be transferred to any place at any time during service. While effecting transfers, the organizational interest, which is primarily student-
centric, remains the uppermost consideration. In the present day, the entire focus of the Government on education is for recovery of learning loss which has occurred due to the two years of pandemic. Without 81- O.A. No. 860/2022 and connected matters regular teachers in position, it is challenging and difficult to cope with the humungous task entailed to address the same, in a uniform way, across the country. The administrative transfer clause in the KVS transfer guidelines were invoked in view of the dire circumstances. Hence, it is imperative that regular teachers are in position.
(iii) That transfer to desired location based on request is not a matter of right. Nor the undisrupted stay in a particular post or station is a matter of right. The existing Transfer Guidelines of KVS starts with the objective that, "KVS shall strive to maintain equitable distribution of its employees across all locations to ensure efficient functioning of the organization and optimize job satisfaction amongst employees. The Guidelines further defines administrative transfers as, "Those transfers, which the KVS orders suo motu in the exigencies of service, administration and in public interest." It is stated that while effecting transfers all the factors giving benefit from displacement in Para 6 of the transfer guidelines 2021 are kept in abeyance. Further, the routine transfer process has been suspended for the current year 2022-23.
(iv) That KVS has identified around 237 KVs having less than 50% of regular teaching staff on its rolls and about 488 KVs having 80% or more regular teaching staff on its rolls in all over India on the basis of available vacancy. 82- O.A. No. 860/2022 and connected matters
(v) That Station Seniority (All India/cadre/subject wise), which indicates, who has the longest stay in a station, as per date of joining at the station was taken as the criteria for transfer. Most of the teachers, who have been transferred have had a stay in a particular station for more than 10 years. Out of the total teaching staffs of 36565 in position, only 1455 transfers have been effected, which is only around 4% of the total teaching strength in position.
11. It has been further stated by the respondents that transfer guidelines for regulating transfers or containing transfer policies at best may afford an opportunity to the employees to approach the higher authorities for redressal, but cannot have the consequence of depriving or denying the competent authority to transfer a particular employee of KVS to any place in public interest and as is found necessitated by exigencies of service as long as the official status is not affected adversely and there is no infraction of any career prospects such as seniority, scale of pay and secured emoluments. It is further submitted that even if, the order of transfer is made in violation of administrative guidelines, the same cannot be interfered with as it does not confer any legally enforceable rights unless as submitted above the same is shown to have been vitiated by mala fides or made in violation of any statutory provisions. The Sangathan is the best judge to decide how to distribute and utilize the services of its employees. It is further submitted that the power to transfer the employee/the applicant has been exercised honestly, bonafidely and reasonably as this power has been exercised in public interest, which will be elaborated. It is submitted that judicial review of the order of transfer cannot be exercised unless the order of 83- O.A. No. 860/2022 and connected matters transfer is made on irrelevant consideration and that the real foundation of the transfer is based on a measure of punishment. 84- O.A. No. 860/2022 and connected matters
12. The applicant has filed rejoinder. It has been stated therein that once the respondents have issued transfer guidelines, they are duty bound to follow those guidelines. The transfer orders have been issued to cover up the old fault lines and without taking into account equitable distribution of teachers in different regions of the country. It has also been contented that the deficiency in certain regions, which has been made the basis of issuance of impugned transfer orders, have been created on account of the previous illogical and whimsical action, whereby they have issued transfer orders of more than 4200 employees in the past two years. The impugned transfer orders have been issued based upon region wise seniority, whereas it should have been based upon All India Seniority in all regions and keeping in view the strength of teachers in all regions, which has not been done to meet alleged administrative need and to meet the deficiency. It has also been contended that under Clause 5 of KVS Transfer Policy, transfer is made on administrative ground such as to redploy the surplus staff, post employees in hard/NER stations to fill the vacant posts, displacement of an employee from a location to accommodate the request of an employee, who is LTR/DFP/MDG/PH employee/widow/single parent/employee, who have completed tenure in hard/very hard/NER station or rotational transfer of employees working in sensitive posts.
None of the conditions apply in the present case. Vide letter dated 13.10.2022 in response to an RTI application, it has been replied by the respondents that the department does not have information with regard to total number of teachers recruited from Aug 2019 to Feb 2020, how many teachers were transferred to their choice station in annual transfer Drive 2021 within two years of their initial posting and whether the KVS 85- O.A. No. 860/2022 and connected matters followed equal distribution of its employees to all locations excluding hard station in the light of COVID 19 affects on students, while considering the request transfers in transfer Drive 2021 and the criteria followed to issue transfer of LTR/Spouse/Parent, Medical ground person etc. effected in the year 2022.
13. It has also been stated that the KVS have cancelled transfer orders of 106 teachers. It has been pleaded that while cancelling the transfer orders, the transfer guidelines relating to LTR/DFP/MGT/PH have been considered and acted upon partially while claims of those, whose cases fall under other clauses including 6 and 7(d) have been left out conveniently giving them step motherly treatment.
14. It has also been pleaded that instead of filling up the vacancies, the respondents have taken via media of taking recourse to transfer to fill up the vacancy, which circumvented the clause 2.3 of the National Education Policy of India, 2020 (NEP,2020). The NEP, 2020 prescribes for teaching in regional language especially up to 8th. The plea of the applicants is that they do not know the regional language of the State, where they have been transferred to, which is in circumvention of the objects laid in Clause 4.11 and 4.14 of the NEP 2020. Further, as per para 5.3 of the NEP, 2020, the transfers will be conducted through an online computerized system that ensures transparency but the action of the respondents in issuance of impugned transfer order does not show any transparency. The respondents have issued advertisement no. 15/2022 and 16/2022 inviting applications to fill up the 6414 posts of Primary Teachers, 1409 PGT and 3176 TGT. It has been pleaded that after the completion of the recruitment process 86- O.A. No. 860/2022 and connected matters almost the entire deficiency in the alleged regions, where the transfers are being made as well as other regions shall be wiped out. Further, the CBSE has issued the date sheets for 10th and 12th Board examinations and many applicants, who are under transfer, have been appointed on examination duties and their transfer at this stage would not be in the interest of organization, students and school.
15. We have gone through the pleadings, heard rival contentions at length and perused the relied upon case law by both sides.
16. After hearing learned counsel for the both sides, the prayer of the applicant for interim stay was accepted and the respondents were directed not to execute the impugned transfer orders qua the applicants.
17. The genesis of controversy involved in bunch of these 124 cases is the impugned transfer and relieving orders dated 12.09.2022/13.09.2022/ 16.09.2022, whereby the respondents have transferred the applicants on the administrative grounds, with the object of rationalization and redistribution of existing teaching staff and in order to ensure that at least 50% of regular teaching staff are available in all KVs across the country. Learned counsel for the applicant submitted that the respondents have not complied with the actual meaning of rationalization in passing the impugned order as in the above said orders only PGT Economics teacher has been transferred in the whole Chandigarh region, which all are from only KVS operating in Patiala only, therefore, the concept of rationalization has not been abided while issuing the said order. The respondents in passing the impugned transfer orders have ignored the various order/memorandums issued by the DoP&T on spouse unification. The respondents have given transfer policy 2021 a go-bye, so as, it relates to the displacement 87- O.A. No. 860/2022 and connected matters counts and it has been vehemently argued that the impugned orders have been passed by the respondents late night on 12.09.2022, whereby the clause 6 of transfer policy has been kept in abeyance. In order to examine the element of rationalization and re-distribution, we have gone through the minutes of KVS review meeting held on 19.07.2022 and approval accorded by the Hon‟ble Shiksha Mantri, the copy whereof has been produced by the learned counsel for the respondents. The perusal of the same has shown that during meeting, it had been highlighted that the normal schooling has been severely disrupted owing to pandemic situation and there has been significant learning loss amongst students, as per NAS 2021 data, which needs to be addressed on priority basis to achieve learning outcome. Therefore, it was decided to propose mechanism for rationalization of teachers and re-distribution of existing teaching staff from the schools having more than 80% of regular strength to ensure that in every KV at least 50% regular teaching staff (inclusive of all cadres) are available. The total 488 KVs were identified having 80% or more regular teaching staff and 237 KVs were found to having less than 50% regular teaching staff on their rolls. On the basis of these data, it was decided that around 1260 regular teachers need to be re-distributed, so that, all the KVs have at least 50% regular teaching staff. In order to achieve the said goal, the proposal was finalized as under:-
"a. Only administrative transfers to be effected for the purpose of redistribution of teaching staff in accordance with provisions regarding „administrative transfers‟ that are already existing in the KVS transfer guidelines.
88- O.A. No. 860/2022 and connected matters b. All the factors giving benefit from displacement in Para 6 of the transfer guidelines 2021 to be kept in abeyance. c. KV with 80% (488 KVs) teaching staff in position to be re- distributed and to be moved to other regions having KVs with less than 50% (237 KVs) of teaching staff on the basis of station seniority. Detailed analysis of school-wise (region-wise) list with student strength to be submitted to the EM office. d. Surplus staff in the academic year 2022-23 to be redeployed to KVs with more than 50% vacancies.
e. The routine transfer process to be suspended for the current year (that is, to accommodate the request of teaching staff as well as the administrative transfer from/to NER/Hard Station KVs and normal choice station and vice-versa posting after completion of tenure in NER/Hard Station KVs) f. However transfers to be considered on grounds of Death of Family Persons and serious Medical grounds on a case-to-case basis."
18. In the minutes of meeting held on 19.07.2022, it was also decided that the teachers, who were falling under the exemption clause mentioned in para 6 thereof, will be exempted from the said administrative transfer drive. For better understanding, the exemption clause as detailed in the minutes of aforesaid meeting is reproduced as under:-
"6. Grounds for Exemption 89- O.A. No. 860/2022 and connected matters Teachers coming under the following categories will be exempted from the said administrative transfers:
i. Staff with less than three years of service left for superannuation (as on 1st July 2022) ii. Staff with physical disability and staff as care giver to persons with disability in the family (spouse or dependent son/daughter) iii. Staff with any of the nine medical conditions listed in the transfer guidelines.
iv. Staff who have not completed 5 years of stay in the station."
19. We have found that though para 6 of the transfer guidelines 2021 was kept in abeyance in the instant transfers on administrative grounds, however, certain parameters were fixed by the respondents for exemption of certain categories of teachers from the said transfer drive.
20. We have noticed that the applicants in O.A. No. 903/2022, 914/2022, 923/2022, 954/2022, 960/2022, 962/2022, 963/2022, 985/2022, 987/2022 & 1017/2022 were found to be falling under the exemption clause of para 6(i) of the minutes, however, they have been transferred from their present place of posting to remote areas contrary to the proposal.

Similarly, the applicants in OAs No.869/2022, 872/2022, 876/2022 and 882/2022 are found to be figuring in the medical condition list in the transfer guidelines, but despite the exemption clause, they have been transferred. In the clause (f) of the final proposal, it was decided that the transfer on the ground of serious medical ailment shall be considered on case to case basis. The applicants have filed their representation on the ground of medical 90- O.A. No. 860/2022 and connected matters ailment, but the same remained un-responded. The benefits of exemption clause have been given to 106 teachers. However, the applicants referred hereinabove have not been granted the same relief, which is discrimination to the applicants falling under exemption clause. Further the order dated 13.09.2022 to the extent it states that no representation from such employees should be entertained or forwarded is contrary to para (f) of the proposal. The aforesaid embargo of non-consideration of representation has nullified any claim of exemption by any of the teachers under the category of Exemption Clause/para 6 of the minutes. Therefore, the order dated 13.09.2022 is bad in law being against the principles of natural justice.

The applicants have also challenged the impugned order on the ground that the impugned transfer order is not in consonance with the National Education Policy, 2020 which prescribes for teaching in regional language especially up to 8th standard. We are also of the view that by the impugned transfer order the applicants have been transferred to far flung areas, the regional language whereof is alien to them. Thus, the posting of such teachers, who do not know the regional language, is not in consonance with the NEP, 2020 and it would not be in the interest of students as well. Therefore, the impugned orders are bad in law being contrary to NEP 2020.
23. Learned counsel for the applicant in O.A. No.895/2022 has taken an additional plea that the impugned order has been passed by the incompetent authority. We have gone through the relevant material provided by learned counsel for the respondents. From the perusal of the same, it is evident that the proposal along with the minutes of the 91- O.A. No. 860/2022 and connected matters review committee dated 19.07.2022 were placed before the competent authority i.e. the Hon‟ble Shiksha Mantri, who being the chairman of KVS, has accorded approval to the proposal vide note dated 04.08.2022, therefore, the said contention of the applicant has no substance and is liable to be rejected.
24. Learned counsel for the applicants have placed reliance upon the decision dated 16.01.2023 in bunch matters with leading O.A. No. 347/2022 titled Kabita Sinha Vs. KVS passed by the Ahmedabad Bench of the Tribunal, wherein it has been observed as under:-
"10. Having regard to the submission made by the learned counsel for the parties and material available on record it emerges that the annual transfer process of KVS has been suspended for the current academic session i.e., 2022-23, only and the current academic session is near to end. It is also important to mention that provisions of Para - 6 of the transfer guidelines of 2021 have been not superseded and have been kept in abeyance. In our considered view the Board of Governance is the only competent body to revise the transfer guidelines whereas respondent failed to show any approval having been obtained by the Commissioner before keeping in abeyance the transfer guidelines. The effect and operation of the impugned transfer order qua the applicants have already been stayed by this Tribunal after considering the facts of the case. Other Tribunals have also granted interim relief against other teachers affected by the impugned transfer order. It cannot be denied that respondents are the best judge to decide 92- O.A. No. 860/2022 and connected matters administrative exigency regarding posting of the teaching staff. However, in the present case, we feel that while passing the impugned transfer order there is some violation of Transfer Policy, 2021 as also Government Order dated 30.09.2009 issued by Department of Personnel and Training.
11. The applicants have been posted far away from the posting place of their spouses who are either in Central Government or State Government or in Public Sector undertakings. Non compliance of the policy regarding posting of husband and wife at the same place has also not been explained by the respondents in reasonable and appropriate manner. It is true that there may be scarcity of teaching staff at some of the places but such situation cannot be dealt with in a way where guidelines of the Government are violated. The principles of natural justice are always expected to be followed by all the departments of Government whereas in the present matter mass transfer to such a distant places in the mid of academic session have been effected without any prior notice as also without granting any joining period.
12. It is not appropriate to transfer the applicants without seeking from them option of posting as per the procedure in place. We are in agreement with the contentions of the learned counsel for the applicants that applicants who are Primary School Teachers would not be able to teach the students at the new place of posting in the different local language of the students in south. It is true the applicants have no vested right to remain posted at a particular place. However, the KVS cannot overlook 93- O.A. No. 860/2022 and connected matters the inconvenience caused to the teachers more so of ladies of primary school by transferring them in the mid-term. Mid-term transfer is not beneficial either to the students at both places and to the family members more particularly who are studying in secondary or higher secondary schools. National Education Policy also discards en masse transfer in the middle of the academic session.

In view of the above circumstances, we are of the view that if the impugned transfer order qua the applicants are not quashed, it will create more inconvenience to all the concerned than to serve the purpose behind effecting the impugned transfer. It will not be in the interest of the students for which the teachers are meant. As stated earlier the academic session is going to complete soon and status quo is already in existence regarding posting place of the present applicants. In the facts and circumstances of the case discussed above, we set aside the transfer order dated 16.09.2022 qua the applicants. However, it is made clear that after completion of the current academic session, the respondents are at liberty to pass fresh transfer order in accordance with the latest transfer guidelines and Government Order as also principles of natural justice."
25. Learned counsels for the applicants have also relied upon various orders passed by the Principal Bench of C.A.T. which gave verdict in favour of the applicants on the basis of order of Ahmedabad Bench of C.A.T in the case of Kabita Sinha (supra). We are in agreement with the aforesaid observations of the Co-ordinate Bench of Ahmedabad.
94- O.A. No. 860/2022 and connected matters
26. The Hon‟ble High Court of Allahabad while disposing of an identical matter titled Vimi Handa Vs. The Commisioner KVS and Others (Writ-A No. 2083 of 2023 decided on 03.03.2023) held as under:-
"Having heard learned counsel for the parties, we are of the opinion that normally transfer orders passed in respect of employees serving an organization need not be interfered with for the reason that they are either passed in exigencies of administration or other on administrative grounds. However, we are of the opinion that transferring the petitioner at a distant place 1100 kms. away from Lucknow may not serve the purpose of achieving the objectives of Kendriya Vidyalaya Sangathan as she has been suffering from certain ailments. In case, transfer is contemplated at such distant places, the authority concerned should be mindful of the difficulties, which such transfer may cause, which ultimately may not be in the interest of the organization itself."
27. As of now, the academic session 2022-23 has been completed and academic session 2023-24 is going on. Moreover, the benefit from displacement in para 6 of the transfer guidelines 2021 was kept in abeyance only. Therefore, nothing more survives as on date for consideration. Further, the embargo of Transfer Policy 2021 has already been relaxed with the implementation of Transfer Policy, 2023.
The respondents have invited options as per the new transfer policy dated 30.06.2023. While some of the applicants tried to exercise their option through online mode, initially they were not allowed to exercise the option giving the following status quo:-
95- O.A. No. 860/2022 and connected matters "You are not eligible to proceed further with transfer application due to ongoing court case. In case any clarifications, please contact your controlling officer or KV HQ."
The applicants again approached the concerned controlling officer of KVS and when they tried to give their option, the following message was cropped up:-
"You are not eligible to proceed further with transfer application due to Administrative reasons. In case any clarifications, please contact your controlling officer."

In our considered opinion, the respondents should have allowed the applicants to exercise their option for transfer pursuant to Transfer policy, 2023, which could have redressed the grievances of the applicants and reduce instant litigation. The object of Transfer Policy, 2021, as mentioned in para (d) of the final proposal, could also have been achieved thereby. The inaction on the part of the respondents is not in consonance with the object of the policy i.e. to ensure optimize job satisfaction among the employees.
Therefore, the denial by the respondents to exercise option by teachers under Policy, 2023 is discriminatory and suffering from the vice of arbitrariness.
29. We are very much conscious that the issue of transfer and posting has been considered time and again by the Hon‟ble Apex Court and has been settled by catena of decisions. It is entirely upon the competent authority to decide when, where and what point of time a public servant is to be transferred from his present posting. Transfer is not only an incident but an essential condition of service. It does not 96- O.A. No. 860/2022 and connected matters affect the conditions of service in any manner. The employee does not have any vested right to be posted at a particular place and cannot claim any vested right to work at a particular place as the transfer order does not affect any of his legal rights and the Court cannot interfere with transfer/posting which is made in public interest or on administrative exigency. But this Tribunal can examine the issue when the action/inaction of the respondents is contrary in implementation of their own proposal.
30. Recently, the Hon‟ble High Court of Madhya Pradesh at Jabalpur allowed the bunch matters with leading case titled Neena Khatri Vs. KVS and Others (M.P. No. 5185/2023 decided on 19.10.2023) with the following directions:-
"(i) Impugned orders of transfer of petitioners passed on 12.09.2022, 13.09.2022 and 16.09.2022 so far as they pertain to petitioners before this Court are set aside.
(ii) The K.V.S. is directed to allow petitioners before this Court to join back at the place from which they were transferred and to continue them awaiting outcome of exercise of fresh recruitment (direct appointment/promotion).
(iii) The K.V.S. is further directed to ensure completion of exercise of fresh recruitment of Teachers of different categories by direct appointment/promotion as expeditiously as possible preferably well before the end of academic session of 2023-24.
(iv) After completion of process of fresh recruitment in the cadre of Teachers (direct appointment/promotion), K.V.S. 97- O.A. No. 860/2022 and connected matters is directed to undertake exercise of rationalization and redistribution on those posts which continued to remain vacant after adjustment of all the fresh recruits appointed/promoted pursuant to aforesaid exercise of fresh recruitment.
(v) Petitioners be also permitted to apply under new transfer policy of 2023 to maintain parity with those Teachers before Principal Bench at New Delhi, Ranchi Bench and Jodhpur Bench of the Tribunal.
(vi) It is made clear that in case any of the petitioners is found liable to be transferred during the process of fresh exercise of rationalization and redistribution after conducting fresh recruitment by direct appointment/promotion, petitioners shall be liable to be transferred as per prevailing transfer policy of 2023.
10. With the aforesaid directions, these petitions stand allowed to the aforesaid extent sans cost."
We are of the view that the applicants herein are also entitled for the same relief on the rule of parity.
31. In view of the discussion hereinabove, all the Original Applications are allowed with the following directions:-
(i) The impugned orders 12.09.2022, 13.09.2022 and 16.09.2022 qua applicants are quashed and set aside.
(ii) The respondents are directed to permit the applicants to apply under new transfer policy 2023 to maintain parity with teachers before 98- O.A. No. 860/2022 and connected matters Principal Bench at New Delhi, Ranchi Bench, Jodhpur Bench as well as before the Hon‟ble High Court of Madhya Pradesh at Jabalpur.
(iii) It is further directed that if any of the applicants is found liable to be transferred during the process of fresh exercise of rationalization and redistribution after conducting fresh recruitment by direct appointment/promotion by the respondents, they have to move as per the prevailing transfer policy, 2023.
Pending MAs also stand disposed of accordingly. No costs.
A copy of this order be placed in all the connected files.
