109. Appeals against award of Collector.
(1)An appeal against the award of the Collector made under Section 92 may be filed to the [Gujarat Revenue Tribunal] [These words were substituted for the words 'Bombay Revenue Tribunal' by Gujarat 22 of 1968, Section 2.] notwithstanding anything contained in the Bombay Revenue Tribunal Act, 1957 (Bombay XXXI of 1958).(2)In deciding appeals under sub-section (1), the [Gujarat Revenue Tribunal] [These words were substituted for the words 'Bombay Revenue Tribunal' by Gujarat 22 of 1968, Section 2.] shall exercise all the powers which a Court has and follow the same procedure which a Court follows in deciding appeals from the decree or order of an original Court under the Code of Civil Procedure, 1908 (V of 1908).
