The State Of Meghalaya vs Shri Philarson Marak on 4 May, 2016

Bench: Chief Justice, S.R. Sen

                            BEFORE
                   HON'BLE THE CHIEF JUSTICE
                  HON'BLE SHRI JUSTICE S.R. SEN

                          MC [WA] No.1 of 2016
                          MC [WA] No.2 of 2016
                          MC [WA] No.3 of 2016
                          MC [WA] No.4 of 2016
                          MC [WA] No.5 of 2016
                          MC [WA] No.6 of 2016
                          MC [WA] No.7 of 2016
04.05.2016

The State of Meghalaya is in appeal against the common
order dated 06.11.2015 as passed by the learned Single Judge of this
Court in a batch of writ petitions led by WP(C)No.290 of 2014.
These appeals are reportedly time-barred by a period of 61
days. However, it is an admitted position that the other appeals arising out
of the same order dated 06.11.2015 have already been admitted for
consideration and are posted for hearing in the monthly hearing list.
Learned counsel Mr. KC Gautam, appearing for the
respondents in these appeals (who are the writ petitioners) has frankly not

put to contention the prayer for condonation of delay, and rightly so.

Having regard to the submissions made, we are satisfied that the delay in filing these appeals had not been intentional; and it shall be just and proper to consider these appeals on merits along with the other appeals arising out of the same order that had already been admitted for consideration.

Accordingly, these applications for condonation of delay are allowed. The delay in filing the appeals is condoned. The writ appeals are taken on the regular side and be registered accordingly. These appeals shall be taken up for hearing along with the batch of appeals led by WA No.35 of 2015.

These miscellaneous cases stand disposed of accordingly.

             JUDGE CHIEF JUSTICE
