O R D E R (ORAL)
Hon'ble Mr. R.N. Singh, Member (J):
In the present OA filed under Section 19 of the Administrative Tribunals Act, 1985, the applicants have prayed for the following relief(s):
"a. Quashing and setting aside of 'NDMC order no.
O(H)/NDMC/2016/1482 dated 11.03.2016 [Annexure A-1] qua applicant Staff Nurses, so long it denies, shows the benefit of 'NFSG' granted to the Applicants from a date later then 15.07.1998/their completing 03 years of eligible service;
b. Directing respondents to forthwith issue its revised operative order, in respect of applicant Staff Nurses, following the admitted, applicable decision, clarification 'Senior most persons first be awarded ACP Scheme, thereafter juniors may be considered against the upgraded posts of Nursing Personnel' [Annexure A -6] thereby granting, grading the Applicant Staff Nurses in the 'NFSG' pay scale of Rs.5500 SO00 with benefit of fixation of pay under FR 22 (1)(a)(1), in terms of its order no.AO (H)VAK/GF-105/09/1950 dated 23.02.2009 [Annexure A - 11] with effect from 15.07.1998/their completing 03 years of eligible service, as the case may be, with arrears along with interest@9 % per annum, recoverable from salaries of officers of the Corporations' for forcing the applicants into this otherwise avoidable litigation, with all consequential reliefs and benefits.
b. Directing respondents to revise, grant to the applicants, all their subsequent benefits granted under Assured Career Progression Scheme, Modified Assured Career Progression Scheme from their revised date of eligibility as determined after grant of aforesaid up-gradation as per the provisions of the Modified Assured Career Progression Scheme and to make, payment of 27 O.A. No. 1622/2016 M.A. No.1591/2016 Item No. 37 salary, arrears, as per revised fixation of pay so arrived with all consequential reliefs and benefits; c. Costs of this application may also be recovered from officers of the respondent no.1 and granted to the applicants;
d. Any other or further order or direction to grant complete relief to the applicants."
2. Pursuant to notice, the respondents have filed counter reply and have opposed the OA.
3. After arguing at length, Mr. Pardeep Kumar, learned counsel for the applicants submits that the present OA may be disposed of with liberty to the applicants to make a comprehensive representation(s) for the relief(s) sought in the present OA and with a direction to the respondents to consider and dispose of such representation(s) in a time bound manner.
4. To such a request of learned counsel for the applicants, there is no opposition from the learned counsel appearing for the respondents.
5. In the facts and circumstances, with the consent of the learned counsels for the parties and without going into the merits of the case, the present OA is disposed of with liberty to the applicants to submit an individual comprehensive representation(s) for redressal of their grievances, if any, before the competent authority under the respondents within four weeks from today and if such representations are received by the 28 O.A. No. 1622/2016 M.A. No.1591/2016 Item No. 37 respondents within the time stipulated hereinabove, they shall consider and dispose of the same by passing an appropriate reasoned and speaking order as expeditiously as possible and preferably within three months of receipt of such representation(s).
6. The OA is disposed of in the aforesaid terms. No costs.
7. Pending MA, if any, shall also stand disposed of accordingly.
