The applicants were appointed as Principals in the Kendriya Vidyalaya Sangathan (KVS) through the process of direct recruitment. They made a representation to the respondents herein with a request to extend the benefit under the Modified Assured Career Progression Scheme(MACP) to them. The representation was considered by the KVS and in a way, a recommendation was made to extend the benefit to them. However, the Ministry of Human Resources Development, Department of School Education and Literacy turned down their request through communication dated 15.07.2013. It was reiterated in letters dated 06.06.2014 and 09.04.2015. They are challenged in this OA.9

The applicants contend that the Advanced Career Progression Scheme(ACP) was introduced in light of the recommendations of the 5th Pay Commission and at that time it was adopted by the KVS only to the non teaching staff on the premise that in respect of teachers, a time bound progression scheme was in operation. It is stated that the Principals constitute a class by themselves which cannot be treated as part of teaching category and they are entitled to be extended the benefit of MACP particularly when there are no promotional avenues for them.
3. On behalf of respondent Nos. 1, 3 and 4, a detailed counter affidavit is filed challenging the OA. It is stated that when the ACP was introduced, the KVS has categorically informed the Govt. that they do not intend to implement the same in respect of their teaching employees in view of the existence of a time bound promotional scheme and even the Teachers Association has opined such. They contend that once the ACP is not in force, the question of applying or adopting MACP does not arise. The second respondent, KVS has, in a way, supported the case of the applicants.

4. We heard Shri C. Bheemanna, learned counsel for the applicants and Shri S.Rajappa, learned counsel for respondent No.2 and Shri R.K. Sharma, learned counsel for respondent Nos.1, 3 and 4.
5. The ACP Scheme was introduced on the basis of recommendations of the 5th CPC, to provide financial upgradation wherever the promotional avenues are almost absent. This was done with a view to avoid stagnation and to ensure a periodical enhancement in emoluments. The ACP provided for two financial upgradations on completion of service of 12 years and 24 years, subject to verification of their performance. The 6th CPC, however, slightly modified the Scheme, instead of two upgradations. The 6th CPC suggested three upgradations on completion of service of 10 years, 20 years and 30 years.
6. Further, ACP was applied to employees of categories B, C and D and isolated Group 'A' officers, but not to officers of organized Group 'A' service. MACP applies to all Group 'A' officers other than from the organized group 'A' service, in the organization which adopted the ACP.

7. The claim of the applicants could have been accepted only if they were covered by ACP Scheme. MACP does not have any independent constituency of its own. It is not the case of the applicants that it was enforced in any organization independently and in the absence of ACP.
8. The applicants placed reliance upon an Order of this Tribunal dated 27.02.2015 in OA No.2639/2012. That is a case of the Principals of the school in the Delhi Administration. It is not in dispute that the Delhi Administration has adopted the ACP Scheme in respect of its teaching and non teaching staff and officers of the Directorate of Education of the State. In the instant case, the KVS has not adopted the ACP for its teaching staff. Therefore, the question of extending the MACP to the applicants does not arise.
9. Though, it is urged that the applicants belong to a different category, we are not inclined to address that question. The reason is that the question if at all was required to be addressed, when the ACP was implemented and not at this stage.

10. We do not find any basis to interfere with the impugned orders. The OA is accordingly dismissed. There shall be not order as to costs.
