1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
"a) Declare that the acts of Respondent No. 2 in entering into an undocumented, brand-specific, and foreign collaboration with Canva Pty Ltd., on whom an injunction order is operating in India, without tender, MoU, data safeguards, legal scrutiny, or approvals, are illegal, ultra vires, and in violation of the applicable law including the This is a digitally signed order.

b) Issue an appropriate writ of mandamus or any other writ, order, or direction thereby directing the Respondents, their officers, agents, or affiliates to cease, revoke, and completely discontinue any form of engagement, facilitation, or collaboration with Canva Pty Ltd., and to permanently terminate all digital, access granted under the "Canva for Education" initiative; and to purge, delete, and remove all data, user accounts, access credentials, content repositories, user onboarding details, and metadata created, stored, or transferred under such unauthorized association with Canva Pty Ltd., and to report full compliance to this Hon'ble Court;
c) Issue a writ, order, or direction directing the Respondents to issue a show-cause notice to Canva Pty Ltd to take appropriate action, including blacklisting for willful suppression of the subsisting court injunction, utilised Respondents' infrastructure to demonstrate injuncted feature and not informing Respondent No 2 about injunction order operating on them even after contempt application hearing commenced;
d) Direct the Concerned Officer / Director of Respondents No 2, to file an affidavit detailing the procedure, documentations, authorisation, protocols followed and executed which empowered the Director, Skill Education, This is a digitally signed order.

e) Direct the Respondents, to produce and disclose the complete record of the engagement with Canva Pty Ltd., including all correspondence, internal notes, digital communication logs, draft or executed agreements (if any), webinar materials, social media announcements, WhatsApp groups, YouTube and Webex transcripts, and minutes of meetings regarding the said initiative;
f) Direct the Respondents to conduct an immediate institutional inquiry to identify the officers involved in conceiving, approving, or executing the collaboration with Canva Pty Ltd, on whom an injunction order is operating in India, announcing that in media press release, without following mandatory legal and procedural safeguards, and register an FIR under the Prevention of Corruption Act, 1988, for criminal misconduct under Section 13(1)(a) and
(b) against all responsible officials, including those who enabled the misuse of public office to benefit a foreign entity, thereby causing injury to the Petitioner;
g) Issue appropriate directions to the Central Vigilance Commission (CVC) to conduct an independent and time- bound vigilance inquiry into the unauthorized collaboration between Respondent No. 2 and Canva Pty Ltd., including all This is a digitally signed order.

The brief facts of the case are that the petitioner was granted patent being Indian Patent No. IN 360726 for protection of its invention titled as "A System and a Method for Creating and Sharing Interactive Content Rapidly Anywhere and Anytime". Since the petitioner alleged infringement of its patent, the petitioner filed a commercial suit bearing CS(COMM) 573/2021 titled "RxPrism Health Systems Private Limited & Anr. v. Canva Pty Ltd &Ors." seeking permanent injunction and damages against the Canva Pty Ltd. which is pending adjudication for infringement of the aforesaid patent. A Coordinate Bench of this Court vide Order dated 18.07.2023 passed an interim injunction Order restraining the Canva Pty Ltd. from using any such feature in its product which infringes the aforesaid patent.

The case in the present petition is that the respondent No. 2 namely Central Board of Secondary Education (CBSE) has collaborated with Canva Pty Ltd. for conducting an educational programme and in that programme the feature which was in infringement with the said patent was highlighted as a unique feature and the respondent No. 2 facilitated such infringement using official digital infrastructure. Hence, the present petition.
4. A perusal of the aforesaid facts shows that the dispute of the petitioner is with regards to infringement of its patent. Thus, it is a private nature dispute against Canva Pty Ltd. for which the petitioner has already filed a civil suit and the same is pending.

5. For the said reasons, I am of the view that there is no violation of any right involving the petitioners for which the extraordinary writ jurisdiction of this Court can be invoked.
6. Accordingly, the petition is dismissed granting liberty to the petitioner to take any/all legal steps available to the petitioner in accordance with law for infringement of its patent.
