Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeals.

Respondent: Mr. Hemant Kumar, Director/B&S-II, Mr. S. L. Rajak, Dy. Director/B & S-II, Rail Bhawan, New Delhi; Mr. Pradeep Kumar, ACM/TCN/Danapur Div., Mr. Arvind Kr. Srivastava, AOM/Danapur Div. and Mr. Vishal Anand, Asstt. Div. Engineer, EC Railway present through video- conference.
Written submissions of the Respondents are taken on record.
In case File No. CIC/MORLY/A/2023/134140:
Ld. Counsel for the appellant contended that the information against point No. 2 of the RTI application has not been furnished by the Respondent.
Mr. Hemant Kumar, Director/B&S-II, Railway Board stated that a reply against Point No. 1 of RTI application has already been provided to the appellant vide letter dated 25.05.2023, while point No. 2 pertains to East Central Railway, Hajipur. Therefore, the RTI application has been transferred to them under Section 6(3) of the RTI Act. Point No. 2 of the RTI Application was also replied Page 8 of 11 to the appellant vide letter dated 15.06.2023 (as mentioned above). No further information lies with the office.
In case File No. CIC/ECRHJ/A/2023/129992:
Ld. Counsel for the appellant pleaded that a satisfactory reply on all the points has not been furnished by the CPIOs.
Respondent stated that reply against each point has already been provided to the appellant with relevant enclosures vide letters dated 16.05.2023 and 16.06.2023 as pe available records.
In case File No. CIC/ECRHJ/A/2023/130007 & CIC/ECRHJ/A/2023/130006:
Ld. Counsel for the appellant restricted his arguments to point No. 6 and 7 of RTI application by contending the incomplete information has been provided at point No. 6 while at point No.7 the CPIO should have transferred the RTI application to the concerned CPIO by invoking Section 6(3) of the RTI Act, instead of advising the appellant to go for the inspection of records. He prayed the Commission to direct the respondent to provide complete information on both the points.
Respondent (Mr. Vishal Anand, Asstt. Div. Engineer, EC Railway) submitted that point-wise reply as per available records has already been provided to the appellant along with an opportunity of inspection of relevant records, which he did not avail.
At the behest of the Commission, respondent has agreed to reiterate one more opportunity of inspection of relevant records to the appellant on point No. 6 and 7 in case File No. CIC/ECRHJ/A/2023/130007 and against point Nos. 2 to 8 in case File No. CIC/ECRHJ/A/2023/130006, which Ld. Counsel for the appellant agreed to avail.
Decision:
The Commission after adverting to the facts and circumstances of the case, hearing both the parties and perusal of the records, observes that as far as Page 9 of 11 present RTI applications are concerned, appropriate replies has been provided by the respondents vide letter dated 16.05.2023, 15.06.2023, 16.06.2023 and 25.05.2023, and the clarification given by the Respondents during the hearing serves the purpose of appellant of filing these RTI application, in terms of RTI Act. Hence, no relief can be ordered in case File Nos.
CIC/MORLY/A/2023/134140 and CIC/ECRHJ/A/2023/129992.
In case File No. CIC/ECRHJ/A/2023/130007 & CIC/ECRHJ/A/2023/130006:
In furtherance of hearing proceedings, the Commission directs the Respondent, Mr. Vishal Anand, Asstt. Div. Engineer, EC Railway, Danapur Division to afford one more opportunity of inspection of records pertaining to point No. 6 and 7 of RTI application in case No. CIC/ECRHJ/A/2023/130007 and against point Nos. 2 to 8 of RTI application in case File No. CIC/ECRHJ/A/2023/130006 to the Appellant on a mutually decided date and time within four weeks from the date of receipt of this order. Intimation of date and time should be sent to the Appellant well in advance in writing. Copy of records as may be desired by the Appellant be provided upon receipt of requisite fees as per RTI Rules. While complying with the directions, the CPIO is further directed to take acknowledgement from the Appellant on the list of records etc. inspected by him Information which are exempt as per the RTI Act may be redacted/severed.
FAA to ensure compliance with the directions.
The instant appeals are disposed of accordingly.
