ORAL ORDER
2 31-01-2024Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 307/498A/34 and other ancillary sections of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.
3. It is a case of torture and harassment for dowry. Patna High Court CR. MISC. No.2136 of 2024(2) dt.31-01-2024 2/2
4. Learned counsel appearing for the petitioners submits that the petitioners are in-laws of the victim. Allegation of torture and harassment is general and omnibus and no overt act has been alleged against them. They are separate in mess and business. Injuries sustained by the informant have been found to be simple in nature.
5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Ballia Police Station Case No. 214 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
