2. By way of present petition, the petitioner is seeking pre-arrest bail in connection with an FIR No.107/2026 dated 05.04.2026 under Section 303(2) of the Bharatiya Nyaya Sanhita 2023 (BNS) at Police Station, Nalagarh, District Solan, H.P.
3. The pre-arrest bail application filed by the petitioner had been rejected by the learned Additional Sessions Judge, Nalagarh, District Solan, H.P., on the ground, that anticipatory bail is not to be granted as a matter of rule. Further, the petitioner has allegedly committed theft of two buffaloes belonging to the complainant Manjur Khan, and recovery of the same is yet not effected. 4. Keeping in view the fact that the normal rule is to grant bail and jail is an exception, it is ordered that in the event of arrest of the petitioner, he be released on interim of bail, subject to his furnishing personal bond in the sum of rt Rs.50,000/- with one surety of the like amount, to the satisfaction of Arresting Officer, till further orders. The petitioner shall join the investigation as and when directed by the Investigating Officer.
