                                    ORAL ORDER

(Pronounced by Hon'ble Shri. S. N. Terdal, Member(J)) The applicants have filed this OA seeking the following reliefs:

"i. To set aside the Circular bearing ref. No. 60 dt. 08.07.2020 issued by the 4th respondent seeking to implement own merit concept in Highly Skilled, Highly Skilled-II, Highly Skilled-I which is a non-selection posts based on OM dt. 10.08.2010 and OFB letter dt. 07.12.2010 as being illegal, arbitrary, contrary to the OM dt. 15.06.2018 and orders passed by the Hon'ble Supreme Court and, ii. To direct the 4th respondent to give individual notice to the applicants regarding revised date of promotion, seniority, reduction in pay scale and to publish promotion roster from 07.12.2010 for each category and;
iii. To direct the 4th respondent factory to drop all further proceedings pursuant to the OM dt. 10.08.2010 issued by the 2nd respondent department and;
iv. To pass such other orders or directions as this Hon'ble Tribunal may deem fit and proper in the circumstances of the case, award costs and thus render justice."

2. Mr. Su. Srinivasan appeared on behalf of the respondents on advance notice.

3. This OA has been filed challenging the impugned order dt. 08.07.2020. From the perusal of the said order, it is clear that it is a show cause notice giving an opportunity to the applicants to submit representation. The applicants have submitted representations on 21.07.2020. But without giving an opportunity to the respondents to pass a final order, they have approached the Tribunal.

4. Since six months have not yet been completed after giving representation nor is there final order as required under section 20 of the Administrative 10 MA 217/2020 in & OA 371/2020 Tribunals Act, this application is premature. The respondents have to be given reasonable time to pass final order on the representation.

5. In view of the above, OA is dismissed. Connected MA 217/2020 also stands dismissed.

6. The applicants are at liberty to approach this Tribunal after final orders are passed or the time period of six months is over.
