Heard Sri Ravi Kant, learned Senior Advocate assisted by Sri Shivam Yadav, learned counsel for the petitioner, Sri Alok Singh, learned Advocate holding brief of Sri Ramendra Pratap Singh, learned counsel for the respondent No.2, learned Standing Counsel for the State and perused the record.

By means of this writ petition under Article 226 of the Constitution, the petitioner has prayed a writ or direction in the nature of mandamus commanding the respondent authority to grant zero period to the petitioner pursuant to the decision taken by the Revising Authority vide order dated 29th August, 2019 as the petitioner had been handed over the possession of land in 2016 only and, therefore, the petitioner was entitled for zero period up to 31st March, 2016.

Initially, learned counsel for the respondent No.2 was directed to have instructions in the matter as to why even after the order had been passed by the Revising Authority on 29th August, 2019 to take decision in the matter by revisiting the entire issue of grant of zero period as framed by the petitioner, the decisions had not been taken till date.

Sri Alok Singh, learned counsel for the petitioner submits today that only three weeks further time may be granted in the matter and the competent authority shall take decision in the light of the directions issued by the Revising Authority in its order dated 29th August, 2019.

In view of the above, the writ petition stands disposed of with a direction to the respondent No.2 to take a decision in the matter pursuant to the order passed by the Revising Authority dated 29th August, 2019, as per undertaking advanced in its behalf, within a period of three weeks from the date of production of certified copy of the order.
