Petitioners are apprehending their arrest in connection with Balumath P.S. Case No. 35/2022, registered under Sections 379/ 414/ 34 of the Indian Penal Code and Section 21 of Minor and Minerals Regulation and Development Act, 1957 and Section 13 of Jharkhand Minerals (Prevention of Illegal Mining, Storage, Transportation) Act, 2017 and Section 54 of the J.M.M.C Rules, 2004, pending in the Court of learned C.J.M., Latehar.
On the basis of confidential information that illegal coal was being mined and used in Brick Kilns at Balumath, the informant party raided several brick kilns and recovered huge quantity of illegal coal.
It was submitted that the name of this petitioner has transpired on the basis of confidential information that he was involved in illegal mining of coal. It was further submitted that names of the persons who had spelt out the name of the petitioners has not been disclosed.
Regard being had to the facts and circumstance of the case, I am inclined to extend the privilege of Anticipatory Bail to the petitioners. They are directed to surrender before the court below within two weeks from the date of receipt/production of copy of this order, and in the event of their arrest or surrender they shall be enlarged on bail on furnishing bail bonds of Rs. 25,000/- (Twenty five Thousand only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Latehar in connection with Balumath P.S. Case No. 35/2022, Subject to the conditions as laid down under Section 438 (2) Cr.P.C.
