Learned counsel for the petitioner undertakes to remove the defects pointed out by the stamp reporter within two weeks after the lockdown is over.
In view of personal undertaking given by the learned counsel for the petitioner, the defects pointed out by the stamp reporter are ignored for the present.
The petitioner has been made accused in connection with Katras (East Basuria O.P.) P.S. Case No. 222 of 2020 registered under sections 147, 148, 149, 341, 323, 324, 504, 506, 307, 353, 427 of the Indian Penal Code and Section 25(1-B)A/26/27/35 of Arms Act and Section 3/4 of Explosive Substance Act.
The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner along with 100-150 persons tried to disturb peace and stopped the production of Deco Outsourcing Company and also assaulted the employees of the said company and injured them. It is further submitted that the allegations against the petitioner are all false and are general and omnibus in nature. It is also submitted that the co-accused, with similar allegation, has been admitted to bail by this Court vide order dated 19.02.2021 passed in B.A. No. 1355 of 2021. It is next submitted that the petitioner has been in custody since 09.09.2020 as has been mentioned in paragraph no. 1 of the bail application. It is lastly submitted that the petitioner undertakes to cooperate with the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail.
Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dhanbad, in connection with Katras (East Basuria O.P.) P.S. Case No. 222 of 2020 with the condition that he will cooperate with the trial of the case.
