JUSTICE M.N. BHANDARI Judgment 17/04/2017 Learned counsel for petitioner submits that by afflux of time, impugned order dated 23.4.2015, debarring the petitioner to participate in future tenders for a period of two years would render infructuous as it is going to be expired on 22.4.2017. The petitioner is not intend to press for refund of security amount but prayer is to observe that debaration may not be taken as stigma against the petitioner for future tenders.
I have considered submissions and find that the period of debaration is going to expired on 22.4.2017 i.e. after a period of (2 of 2) [CW-9833/2016] five days from today thus learned counsel has rightly termed it to be an infructuous petition when he is not pressing for refund of security amount. After expiry of the debarration period, no stigma remains, rather, one is allowed to participate in the future tenders.
In view of above, no further finding is required to be given. The writ petition is disposed of with the aforesaid.
