[1]. Learned counsel for the petitioner contends that the amount awarded by Motor Accident Claims Tribunal was deposited in FDR to the extent of 50%. Petitioner is in dire need of money on account of her being suffered with Carcinoma/Cancer.
[2]. Learned counsel further submits that fixed deposit of such amount in case of adults is not proper, in view of observations made by the Hon'ble Apex Court in H.S. Ahammed Hussain Vs. Irfan Ahammed, (SC) 2002(3) RCR (Civil) 563.
[3]. Since the deposit was made as per orders of the Motor 1 of 2 ::: Downloaded on - 01-10-2016 05:21:13 ::: CR No.6289 of 2016 Accident Claims Tribunal, therefore, the bank would have no obvious objection.
[4]. In view of aforesaid, let amount deposited in fixed deposits be made available to the petitioner along with consequent interest applicable thereto within two weeks from the date of receipt of certified copy of this order.
[5]. Disposed of.
