Information sought:
The Appellant sought information regarding the date of commencement of SSC- 67 Course at OTA, Chennai and the date on which IC-56273P Col Nikhil Pareek reported for it.
Grounds for the Second Appeal:
The CPIO has not provided the desired information.1
Relevant Facts emerging during Hearing:
The following were present: -
Appellant: Present through VC.
Respondent: Lt Col A.K. Dahiya, SO-I (Education) & PIO, Academic Department, Officers Training Academy, St Thomas Mount, Chennai present through VC.
Appellant stated that he has received information on 19.07.2019 but expressed his anguish that the PIO has taken nearly 20 months to provide the information sought in the instant RTI Application. PIO submitted that the RTI Application was transferred from RTI Cell, Sena Bhawan, IHQ of MoD to PIO, OTA, Chennai on 10.01.2018 and a reply was provided to the Appellant on 22.01.2018. Decision Commission upon perusal of facts on record as well as the proceedings during hearing observes that the then PIO, Lt. Col. P. Srinivasan has erred in denying the information under Section 8(1)(j) of the RTI Act as the information sought in the instant RTI Application is pertaining to the Appellant himself.
Commission expresses serious displeasure over the conduct of the then PIO, Lt. Col. P. Srinivasan for not paying proper attention to the contents of the RTI Application before sending reply.
The present PIO is directed to serve a copy of this order on the then PIO to take note of the adverse comments of the Commission.
The appeal is disposed of accordingly.
