All the appeals are being disposed of by this common judgment, inasmuch as the common questions of facts and laws are involved therein. They arise from the common judgment dated 08.09.2023 passed in below noted writ petitions by Ld. Single Judge.
[2] The appellants in all the cases are Special Police Officer (for short SPO) engaged in different districts of Tripura. In WP(C) No.40 of 2021, total numbers of petitioners were 311, out of whom 151 numbers of petitioners have preferred related appeal bearing number WA 144 of 2023. Similarly, out of 310 numbers of petitioners in WP(C) 769 of 2021, 134 numbers of petitioners have preferred the appeal bearing number WA 145 of 2023. Similarly, in WA No.146 of 2023, out of 215 writ petitioners of WP(C) No.771 of 2021, 91 petitioners have preferred the appeal. In case of WA No.147 of 2023, out of 350 numbers of writ petitioners of WP(C) No.770 of 2021, 91 numbers of petitioners have preferred the appeal. Likewise, in WA No.148 of 2023, out of 350 numbers of petitioners of WP(C) No.772 of 2021, 190 numbers of them have preferred the appeal. Page 54 of 64 [3] All the appellants were appointed as Special Police Officer (for short SPO) in different districts of Tripura by the concerned DM & Collector of the District under Section 17 of The Police Act, 1861 on different dates during the period from 2001 AD. to 2009 AD. As alleged by the appellants, since their engagement they are continuing to discharge their function as SPO. Meanwhile, Tripura Police Act, 2007 came into force with effect from 07/04/2007 repealing Police Act, 1961 regarding its applicability in Tripura. It is the grievance of the appellants that from the year 1998 onwards, a massive extremist problem erupted in the State of Tripura, and due to the insufficiency of the police force to deal with that menace; the said SPOs were engaged to combat the issue by assisting the regular police force in every district of the State. But their services were thereafter not discontinued and even every year they are required to undergo refresher training for a month as organised by the Police Department. Their services were not regularized yet and their honorarium though initially was Rs.1,500/- per month, but from time to time it was increased and presently, they are paid an amount of Rs.6,156/- per month. In that backdrop, they filed the writ petitions with the following identical and similar reliefs:
"1.. Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/directions of like nature shall not be issued whereby directing the Respondents to regularize the service of the Petitioners in the post of Constables.
2. Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/directions of like nature shall not be issued whereby directing the Respondents to provide the Petitioners monthly wages which comes to minimum of the pay to which the Police Personnel of the State are entitled to till the regularization of the Petitioners.
3. Issue Rule upon the Respondents to show cause as to why a writ in the nature of Mandamus and/or order/orders and/or direction/directions of like nature shall not be issued whereby directing the Respondents to provide the Petitioners Kit allowances, Ration and other allowances which are admissible to the Constables."Page 55 of 64
[4] Ld. Single Judge rejected all the writ petitions observing that to get a direction of regularisation, regular sanctioned vacant posts must exist and it is incumbent upon the petitioners to show that they were appointed following the established norms of public appointment as enshrined in Art.14 and Art.16 of the Constitution. Ld. Single Judge also observed that the State had already framed the recruitment rules namely, Recruitment Rules of Constable of Tripura Police (Men & Women) Rules, 2021 wherein provisions were made for recruitment of SPOs to the post of Constable provided they were within the age group of 18 to 30 years as on 1st day of January on which selection was held and that they possessed requisite academic qualification provided in the rules.
[5] Regarding the alternative claim of the appellants for monthly wages equivalent to minimum of the pay to which police personnel of the State are entitled, Ld. Single Judge observed that the objectives of the creation of posts of Police Constables by the State Government was in conformity with the recruitment rules framed under Article 309 of the Constitution of India and the employment of SPOs by the District Magistrate of the concerned district on recommendation of Inspector/Superintendent of Police of the said district was completely different which created two separate and distinct classes and not a homogeneous group and, therefore, difference of pay structure between these two groups were inevitable. Ld. Single Judge went further to observe that the mode of recruitment to the post of SPOs and that of the post of Constables in Tripura were quite different, since there was no age bar in engagement of SPOs and even, a person who had gone on voluntary retirement might be appointed as SPOs and Tripura Police Act, 2007 also did not lay down any rigid criteria as regards educational qualification for recruitment of SPOs unlike the Constables. Finally, Ld. Single Judge turned down the claim of equal pay for equal work and rejected all the writ petitions with the following observations:

"23.3 However, before I conclude, I direct the respondents to examine whether the services of any of the SPOs are utilized against any permanent or sanctioned regular posts, in that event, such SPOs would be entitled to draw wages at the minimum of the pay scale, (at the lowest grade, in the regular pay scale), extended to regular constables or drivers, keeping in mind the principles set out here-in-above and such exercise shall be completed within 6(six) months from the date the petitioners shall furnish a copy of this order to their competent authorities."
23.4 Subject to aforesaid directions mentioned in para 23.3, the above batch of writ petitions stands dismissed."
[6] Mr. P. Roy Barman, learned senior counsel appearing for the appellants argues that the engagement of all the appellants were through a fair and transparent selection process in terms of the provision of Section 17 of the Police Act, 1861 and their services are utilized like other police officials like Constables and in fact, they were the front line fighter to combat such extremism. They are also provided, Ld. Sr. Counsel Submits, with arms for that purpose and since then they have been discharging their duties and responsibilities like a regular Police Constable. He further contends that before joining as SPO they all underwent one month training in the Police Training Centre and thereafter also they attended several other training programs, but till date they are not regularized though their services are being utilized by the State continuously and even the State has already taken necessary step for further recruitment of 1100 numbers of SPOs to assist the regular police force and about 398 SPOs are engaged to discharge the duties of Drivers against the enhanced honorarium of Rs.9000/- per month to the utter discrimination with other SPOs, notwithstanding that they consist of one homogenous group.
[7] Learned senior counsel further contends that now the SPOs are getting a meager amount as a monthly honorarium of Rs.6,156/- which is otherwise an exploitation by the State on them. According to him, though the SPOs are exposed to vulnerable and threatening situation which may even claim their lives, but they do Page 57 of 64 not have any social security or any insurance coverage. Even they are also not provided with any weapon allowances like the Constables.
[8] Mr. Roy Barman, learned senior counsel further contends that even the Home Guards who are the auxiliary group of Police Department in maintaining internal security etc. are also provided by the Government with duty allowance at such rate which comes to the minimum of the pay to which a Police Constable is entitled in a month. In this regard, this Court in WP(C) No.689 of 2017 directed that the Home Guards should be allowed monthly wages at such rate total of which should come to the minimum of the pay to which the Police Personnel of the State are entitled. The said direction of the High Court has already been complied with by the State. But, according to learned senior counsel, the SPOs are on better footing as the Home Guards only serve non-arm duties unlike the SPOs. Learned senior counsel also relies on a decision of Hon'ble Supreme Court in Nihal Singh And Others Versus State Of Punjab And Others (2013) 14 SCC 65 submitting that even like the State of Tripura, SPOs were also appointed to combat extremism in Punjab earlier under Section 17 of the Police Act, 1861 and Hon'ble Supreme Court in that case directed absorption of those SPOs in the State. Further, learned senior counsel heavily relies on another decision of Hon'ble Supreme Court rendered in Grah Rakshak, Home Guards Welfare Association Versus State Of Himachal Pradesh And Others, (2015) 6 SCC 247 wherein the Apex Court directed the State Government to pay the Home Guards the duty allowances at such rates, total of which 30 days (a month) comes to the minimum of the pay to which the Police Personnel of the State are entitled. Mr. Roy Barman, learned senior counsel submits that Ld. Single Judge ought to have taken into consideration of above said ratio of Grah Rakshak, Home Guards Welfare Association (supra).
Page 58 of 64[9] Mr. Kohinoor N. Bhattacharyya, learned G.A., and Mr. Dipankar Sharma, Ld. Addl. G.A. on the other hand, contend that the direction of this Court regarding the Home Guards was in the light of direction of Hon'ble Apex Court and moreso, the SPOs and the Home Guards are not on the same footing. Their status, recruitment process, trainings etc. are toally different. It is also argued that the honorariums of SPOs are being enhanced from time to time by the State Government and they were never paid any regular wages. Next point of their argument is that recruitment procedure and eligibility criterion for appointment to the post of Constable as well as training module for training of Constable are quite different and, therefore, in no way they can be equated with a police Constable. It is also argued that if the honorarium of SPOs is paid at par with the minimum of the pay of a police Constable, it will involve a huge financial burden upon the State to the extent of minimum rupees 65 crores per month. Mr. Bhattacharyya, learned G.A. finally submits that all the contentions as were raised by the appellants before the Ld. Single Judge was exhaustingly dealt with and discussed by said Ld. Court and, therefore, no interference is called for in these appeals.
[ 10 ] In Nihal Singh And Others (Supra) as it appears, when there was large scale disturbance in the State of Punjab in 1980s and the State was not in a position to mantain the prevailing law and order situation with available police force, they resorted to the provision of Section 17 of the Police Act, 1861 for appointing Special Police Officers (SPOs), more particularly, for the purpose of security arrangement in the banks in Punjab. While giving direction for absorption of those SPOs in the services of the State, at para No.36 it was observed by the Apex Court that "the creation of posts" necessarily means additional financial burden on the exchequer of the State. Depending upon the priorities of the State, the allocation of the finances is no doubt exclusively within the domain of the legislature. However, as further observed, in that case, the creation of new posts would not Page 59 of 64 create any additional financial burden upon the State, as the various banks at whose disposal the services of SPOs of each of the appellants were made available, had agreed to bear the burden. It was also observed that if absorbing the appellants into the services of the State and providing benefits on a par with the police officers of similar rank employed by the State resulted in further financial commitment, it was always open for the State to demand the banks to meet such an additional burden. Apparently, as no such demand was ever made by the State, the result was that the various banks which availed themselves of the services of the appellants enjoyed the supply of cheap labour over a period of decades. It was also further observed that neither the Government of Punjab nor those public sector banks could continue such a practice consistent with their obligation to function in accordance with the Constitution and Umadevi (3) judgment could not become a licence for exploitation by the State and its instrumentalities.
[ 11 ] Therefore, the matter of financial implication regarding absorption or regularization of SPOs in Nihal Singh and Others (supra) and in the present cases are different. Learned Single Judge has exhaustively dealt with this issue in the impugned judgment at paragraph Nos.10.01 onwards upto paragraph Nos.10.30 and we find no ground to interfere with the decision of Ld. Single Judge in the matter of such regularization. Generally, the court cannot direct the creation of posts as it is a prerogative of the executive or legislative authorities and it involves economic factors (Ref.- Divisional Manager, Aravali Golf Club & Anr. v. Chander Hass, (2008) 1 SCC
683). Later on, again said pricinple was reiterated in Maharashtra SRTC & Anr. v. Casteribe Rajya Parivahan Karmchari Sanghatana, (2009) 8 SCC 556 that creation of posts is not within the domain of judicial functions which obviously pertains to the executive and that the status of permanency cannot be granted by the Court where no such posts exist. Section 17 of the Police Act, 1861 or Section 18 of Tripura Police Act, 2007, as the case may be, does not prescribe any procedure for permanent Page 60 of 64 employment in any government service, rather, a stop-gap arrangement is prescribed thereunder to deal with a situation like disturbance of public peace by way of unlawful assembly, riot etc. through engagement of SPOs for a temporary period, and, therefore, the same does not confer any right upon them to claim for regularization. Thus, Ld. Single Judge committed no error in rejecting such claim of regularization.
[ 12 ] In Grah Rakshak, Home Guards Welfare Association (supra) as relied on by Mr. P. Roy Barman, learned senior counsel as regards equal pay for equal work, the appellants were Home Guards of State of Himachal Pradesh, Punjab and NCT of Delhi and their plea for regularization was dismissed by the High Court. After taking into consideration, the Himachal Pradesh Home Guard Rules, 1971 including Himachal Pradesh Home Guards (Amendment) Act, 2002, Punjab Home Guard Rules, 1963 and Delhi Home Guard Rules, 1959 Hon'ble Supreme Court observed that the Home Guard volunteers are paid duty allowance and other allowances to which they are entitled and there is nothing on record to suggest that they perform duties throughout the year. Moreover, it was the specific case of the State that as and when there was requirement, they would be called for duty or otherwise they would remain at their homes. Therefore, in the absence of any detail about continuity of service, whether on a month to month basis or on a year to year basis, the duties and responsibilities performed by them throughout the year could not be treated with that of the police personnel. Ultimately, Hon'ble Supreme Court did not allow any relief in the form of regularization of their services or the grant of regular appointments. However, taking into consideration the fact that Home Guards are used during the emergency and for other purposes, and at the time of their duty they are empowered with the power of police personnel, it was directed by Hon'ble Supreme Court that the State Government should pay them duty Page 61 of 64 allowances at such a rate, a total of which 30 days (one month) comes to a minimum of pay to which the police personnel of the State are entitled.
[ 13 ] In this regard, profitably reference may also be made to another decision of Hon'ble Supreme Court rendered in State of Madhya Pradesh and Ors. Versus Ramesh Chandra Bajpai, (2009) 13 SCC 65 wherein full Bench (three- Judge Bench) of the Hon'ble Supreme Court discussed the arena of applicability of doctrine of equal pay for equal work and the relevant portion of paragraph No.15 is usefully reproduced herein below:
"It is well settled that the doctrine of equal pay for equal work can be invoked only when the employees are similarly situated. Similarity in the designation or nature or quantum of work is not determinative of equality in the matter of pay scales. The Court has to consider the factors like the source and mode of recruitment/appointment, qualifications, the nature of work, the value thereof, responsibilities, reliability, experience, condidentiality, functional need etc. In other words, the equality clause can be invoked in the matter of pay scales only when there is wholesale identity between the holders of two posts."
[ 14 ] The SPOs in Tripura were earlier engaged as per provision of Section 17 of the Police Act, 1861 by the District Magistrates on the application of the police officers not below the rank of Inspector for engagement of such SPOs from neighborhood areas when it had appeared to them that any unlawful assembly or riot or disturbance of the peace had taken place, or might be reasonably apprehended, and that the police force ordinarily employed for preserving the peace was not sufficient for its preservation and for the protection of the inhabitants and the security of the property in that place. The applicability of Section 17 of the Police Act, 1861 was repealed in Tripura after Tripura Police Act, 2007 came into force and a pari materia provision has also been made under Section 18 of Tripura Police Act, 2007 with little variation that when police force ordinarily deployed in any area is not sufficient to deal with a situation threatening peace and security, the Page 62 of 64 Superintendent of Police or any officer specially empowered in this behalf by the State Government, may at any time by a written order appoint, for a period as specified in the appointment order, any able-bodied and willing person between the age of 18 to 40 years, whom he considers fit to be Special Police Officer to assist the Police Service. By this new provision, power of such engagement has been given to the Superintendent of Police or any officer specially empowered by the State Government, in this regard and the age bar of such engagement has been restricted between the age group of 18 to 40 years. No further provision regarding their mode of engagement has been described in the Act, but regarding the Homeguards, the provisions of the Bombay Home Guards Act, 1947 has been extended to Tripura and vide Notification No.F.26(3)-PD/62 dated 20/12/1962, a separate rules called Tripura Home Guard Rules, 1962 has been framed thereunder in Tripura. In that rules, the appointment of Home Guard has been restricted to the age group of 20 to 45 years and a minimum academic qualification of 4th standard has been prescribed therein. The Home Guards are also required to undergo a medical examination for their appointment. The provisions for constitution of the selection committee for selection of such Home Guards are made therein and the term of office of Home Guard is restricted to 5 years subject to their re-appointment, and the maximum age limit to serve as a Home Guard is 50 years, provided that the Commandant General may relax the age limit in suitable cases. The duties and functions of members of the Home Guards are described in Rule 16 of the Rule of 1962 which is not similar to or identical to the duties of the SPO. Therefore, in no term it can be said that there is a wholesale identity between the SPOs and the members of the Home Guards association. Similarly, the recruitment of Constables in the Police Force of Tripura is guided by the Recruitment Rules of Constable of Tripura Police (Men & Women) Rules, 2021 (in short "the Rules of 2021") wherein, separate procedure has been laid down for the recruitment of police Constables, both men and women, also keeping Page 63 of 64 certain provisions with relaxation for the SPOs to be recruited in that cadre. Ld. Single Judge also discussed elaborately on this issue. Unlike the case of SPOs, the minimum qualifications and age limit with minimum physical standards are prescribed in that Rules for appointment as constables in police force. Therefore, there is also no scope to equate the engagement of an SPO under Tripura Police Act, 2007 or under previous Act with the appointment of a Constable under the Rules of 2021. Ld. Single Judge has therefore, rightly held that the benefit of parity of pay scales for a Constable cannot be provided to the SPOs. For the reasons as discussed above, we do not find any ground to interfere with the impugned judgment. [ 15 ] However, it has been asserted by the writ petitioners that in terms of order dated 20/06/2017 of the High Court passed in WP(C) No.689 of 2017, the Home Guards are being paid monthly allowances as such rate, total of which comes to the minimum of the pay to which the police personnel of the States are entitled and it is informed from the side of State counsel that at present, they are being paid Rs.19,140/- per month. It can also be taken note of that as per notification of Labour Department No.F.22(56)-LAB/ENF/MW/PSG/2022/7642-91 dated 24/11/2023, the minimum wages of a Skilled Private Security Guard has been fixed at Rs.12,290/- per month by the State. Even by notification of Finance Department bearing No.F.5(1)-FIN(PC)/2021/1845-2045 dated 12/03/2024 the remuneration/wages of a DRW(Group-D) have also been enhanced to Rs.410/- per day with effect from 01/01/2024, but the honorarium of SPO has still remained at Rs.6,156/-, whereas the services of SPOs are being utilized by the State for more than one or two decades in maintaining law and order situation with their significant assistance to the regular police force. They also have their right under Article 21 of the Constitution to maintain a decent livelihood and the State and its instrumentalities owe a duty to provide them with a suitable honorarium compatible to the price boom, so that they are not subjected to any sort of exploitation. However, we are also not oblivious to Page 64 of 64 the fact that the enhancement of honorarium of the SPOs has its financial implications upon State exchequer, for which we restrain ourselves from making any observation as to the suitable quantum of such honorarium.
[ 16 ] Therefore, considering the matters in totality, the respondents are directed to take a decision regarding enhancement of the monthly honorarium of the SPOs in light of observations made in paragraph no.15 above, keeping in view the enhancement of honorarium/wages of other groups as indicated above, so that a minimum standard of decent livelihood can be maintained by them. This is in addition to what has been directed by Ld. Single Judge in the impugned judgment at paragraph no.23.3. Needless to say, this direction will not restrict the State Government from granting any sort of further allowances or other benefits to the SPOs in addition to their existing allowances. Compliance with the direction passed in this judgment as well as the direction given by Ld. Single Judge as indicated above should be ensured within 04 months from the receipt of this judgment.
Writ appeals are accordingly disposed of with abovesaid observations and directions without any interference with the impugned judgment.
Pending application(s), if any, also stand disposed of.
