HON'BLE MR. JUSTICE ANUROOP SINGHI Order 06/10/2025

1. The limited question in the present appeal is whether the appellant who is seeking appointment on the post of Teacher Grade-III, Level-II in subject Science and Mathematics in district Jalore, is entitled to be considered as a National Sports Certificate holder and, therefore, get ensuing benefits.

2. Learned counsel for the appellant, Dr. Akshaya Shukla submits that the National Level KVS Tournament was held wherein, the appellant being an excellent sports person, participated. Counsel further submits that the KVS is a national organization and any sports at national level meet should have entitled the present appellant for the benefit of being considered in the category of an outstanding sport person.

Counsel for the respondent submits that the benefit of outstanding sports person can be given only to those who participated in national tournaments recognized by the Indian Olympic Association or concerned recognized National Sports Federation. In the present case, the tournaments were 39 th KVS National Sports Meet-2008 and 40th KVS National Sports Meet- 2009 in the game of Hockey. Although, the appellant secured third and second position but the tournament apparently did not confirm to the parameters required for recognition as outstanding sports person.

This Court has the highest respect for the excellent sport persons and the youngsters who have done well in the sports but at the same time, the parameters and the policy for giving them benefits has to be strictly adhered to. It is apparent that the policy invoked has set a dimension for defining the outstanding sports person for the purpose of benefits in recruitment and the basic parameter that the national tournament ought to be recognized by the Indian Olympic Association or the concerned recognized National Sports Federation, is not fulfilled in the present matter.

5. The Hon'ble Single Judge has also deliberated on the same lines and for the same reasons, has not interfered.

6. This Court, thus, does not find any reason to interfere in this matter.

7. The present special appeal stands dismissed accordingly.

8. Stay petition and pending applications, if any, stand disposed of.
