z, in Mahipal ¥ Rajesh' | the Hon'ble Apex Court held that if is necessary for the Court, white consicering a bal application, to assess whelher, based an the evidentiary race ord, there existed a prima facie or reasonable ground fo believe thal the accused has committed the crime. itis setiied law that when granting bal, a detailed examination of the evidence and eisgborate i documentation of the case's meriis has not io be underiaken. That did sot mean that whilst granting bail, some reasons for orima facie concluding why Dall was being granted did not have to be indinated.,
8. if is settied law that while considering the prayer for grant of anticinatory bad, ihe accusations nature and gravily and the accused's exact role must be properly comprehended before arrest is made. lf there is some doubt as fo the genumeness of the Prosecution, the ordinary course af evernis is thal the accused Is entitled fo ar order of antcinatory ball. The Court must adequately exercise iis jurisdiniinn fu orotect ihe personal Nberty of a ciizen. His also a welhaccepted orinciole that ball is the rule and the jail is the exception. Arrest 5 should be the lasf omtion, and i should be restricied fo those excention cases where arresting the accused is imperalive based on the facts and circurpstances of thal case.
2. This Gourt views the power fo authorize defantian as a very salemn funcion. Ho a@lfects the Uberty and freedom of citizens and needs to be exercised with great care and caution. The afifude of arresting first and then proceeding with the rest is despicable. it has become a handy fool for police officers who lack sensilivily or act with oblique motives

Given the fects and circurmstances of the case, as most of the wiinasses were official winesses and this Court believes thal even i the Patiioner is granted pre-arrest ball, thera cannot be ary apnrshension for the Prosecution that he will farnper with the evidence. The material placed on record discloses thal the Pelitioner has a permanent abods. His not the Prosecution's case that the Pelitioner would fee away from the jurisdiction of the Court.
17. Upon careful review of the avaiable material, as there is no risk of erference wih the angoing investigation by the Petitioner and mast of the investigation is completed, this Court finds thal anticipatory ball can be granted io the Petiioner/A.S uncer certain conditions:
i} Petiioner/Accused No.3 is directed to surrander bedore the Statian a House Officer, Rolugunta Police Station, Anakapalll District, within two (2) weeks from today and upan his surrender, he shall be released on ball upon furnishing a personal bond for Re 20,000/-
