Heard the learned senior counsel for the petitioner as also the learned counsel for the respondent-State and perused the petition papers including the objection statement filed on behalf of the respondent-State.

The learned counsel for the respondent-State was no doubt Digitally signed by Nisha Khulbey Date: 2023.07.20 17:14:27 IST Reason: vehement in his submission that the interim protection granted by this Court, is not liable to be continued as the petitioner may be 2 required for custodial interrogation.
Having heard the learned counsel for the parties and having perused the petition papers, we take note that this Court, while directing notice, had also kept in view the nature of the allegations made against the petitioner in the F.I.R., and in that light, had arrived at the conclusion that the interim protection is required to be granted. In any event, the investigation is under progress and if the requirement of the petitioner to appear before the investigating officer is necessary, appropriate notice may be issued and petitioner shall diligently co-operate in the investigation. Subject to the same and the petitioner also adhering with the requirements of Section 438(2) of the Code of Criminal Procedure, the interim protection against arrest granted to the petitioner shall enure to his benefit until further orders. Petition is accordingly, disposed of along with the pending application(s), if any.
