There is no representation on behalf of the applicant. On 29.01.2026 the following order was recorded:-
"Proxy counsel, Ms. Meenu Sharma, appearing on behalf of Mr. Ajesh Luthra, learned counsel for the applicant, submits that she is not in touch with the applicant. Accordingly, she seeks discharge from the present matter.
The request is allowed.
Issue fresh notice to the applicant. This is the 55th hearing.
Re-notify on 19.02.2026."
2. On the subsequent date, i.e., 19.02.2026, due to paucity of time, the Court Officer of the Bench recorded the presence of both the parties, which is the usual practice followed by the Registry. Same was the situation on the earlier date i.e. on 05.01.2026. In pursuance of the order dated 29.01.2026, a fresh notice was issued to the applicant on 05.02.2026. However, there is neither any appearance on behalf of the applicant nor any request for a pass-over.
2. In view of above, it is presumed that the applicant has lost interest in pursuing the matter. Hence, the present OA DAYADAYAWATI 2026.03.24 WATI 10:28:47 +05'30' 5 Item No.27/ C-5 OA No.1034/2015 stands dismissed in default and for non-prosecution. No order as to costs.
