Information soughtand background of the case:
The Appellant filed an RTI application dated 29.10.2024 seeking information on the following points:
"Please provide all the account details including closed accounts with last three years statement of each account of my deceased parents (Father: Pankaj akshya Adhikari and Mother: Parul Adhikary) in Tamluk Branch (IFSC code: PUNB0018620)."
The CPIO replied vide letter dated 18.11.2024 and the same is reproduced as under:-
"The disclosure of information is exempted under section 8(1)(J) of RTI Act 2005, as no public purpose will be served."
Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 18.11.2024. The FAA vide order dated 09.01.2025 stated as under:-
"The disclosure of information is exempted under section 8(1)(J) of RTI Act 2005, as no public purpose will be served."
Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.
Facts emerging in Course of Hearing:
The appellant was present through video conference.
The respondent Mr. P. Mahapatra, CPIO and Mr. Manvender Tiwari, Chief Manager, were present through video conference.
The appellant inter alia submitted that he has sought account details and last three years account statement of his deceased parents, but the same was not provided by the respondent.CIC/PNBNK/A/2025/603252 Page 2 of 4
The respondent while defending their case inter alia submitted that the appellant has sought account details of third party, hence denied u/s 8 (1)
(j) of the RTI Act. The respondent further submitted that the appellant has neither submit legal heir certificate nor provided any documents for establishing his identity as the son/heir of the deceased parents. The respondent further submitted that the appellant has to provide all the required documents along with the account number, as specified to the bank for seeking information.
Decision:
In the light of the above facts, the Commission noted that the respondent has replied to the appellant vide letter dated 18.11.2024, no further intervention by the Commission is required in the matter, accordingly, the appeal is disposed.
