ORDER
1. The appellant filed an application under the Right to Information Act, 2005 (RTI Act) before the Central Public Information Officer (CPIO), M/o Railways, , Eastern Railway, Kolkata seeking following information:-
"1. Work allotted to M/s Royal India Securities in the last five years, including, inter-alia, (a) Name, address and contact details of the owner/proprietor of the security agency, and (b) Year-wise details of the work allotted, sanctioned amount and duration of the work.
2. Certified copy of the tender notice dated 12-05-2017.
3. Following information in respect of not starting the railway lines from Ahmadpur to Kirnahar and from Kirnahar to Katwa which were Page 1 of 4 scheduled to be functional from 31-03-2016 and 28-02-2017 respectively:-
(a) Name, designation, address, monthly salary and contact numbers of the responsible officers.
(b) Estimated cost for not completing the work on time."
2. The CPIO responded on 06-10-2017. The appellant filed the first appeal dated 16-08-2017 requesting that now the information should be provided to him. As the first appellate authority did not give him any reply, he filed a second appeal u/Section 19(3) of the RTI Act before the Commission on this ground and requested the Commission to take appropriate legal action against the CPIO u/Section 20 of the RTI Act.
Hearing:
3. The appellant, Mr. Natraj Saha was not present despite notice. Mr. Mahavir Singh, Chief Engineer (Construction), Mr. D. K. Kujur, Dy. CEE and Mr. Mohd. Tarique, Dy. Secretary(G) participated in the hearing representing the respondent(s) through video conferencing. The written submissions are taken on record.
4. The respondent(s) informed the Commission that they have already furnished the sought for information with reference to the RTI application as available in their records to the appellant vide their letter dated 06-10-2017. The given reply was also read out by the respondent. Decision:
5. This Commission observed that due information, as available in records, has been provided to the appellant vide letter dated 06-10-2017 and hence, no further intervention of the Commission is required in the matter. However, there is delay in responding to the RTI application and therefore, the concerned CPIO(s) are hereby issued a warning for future to be careful and not to contravene the provisions of the RTI Act, 2005.
6. With the above observations, the appeal is disposed of.
