Pr This is first application under Section 439 of Cr.P.C. for grant of a hy The applicants have been arrested on 22.10.2017 in connection with Crime No.698/2017 registered by Police Station City Kotwali, ad District Satna for offence under Section 34 (2) of the Excise Act.
M It is submitted by the counsel for applicants that the allegation of recovery of 54 bulk litres of country made liquor from their possession of is false. The applicants are aged about 21 and 23 years respectively rt and they are the only bread winner of the family. The applicants are in ou jail from 22.10.2017 and their detention has adversely affected the financial condition of the family. The applicants are ready and willing C to abide by all the conditions which may be imposed by this Court h while granting bail. The applicants have no criminal past and there is ig no possibility of their absconding or tampering with the prosecution H case.
Per contra, the counsel for the respondent/State opposed the application.
Considering the facts and circumstances of the case and without commenting on the merits of the case, the application is allowed. It is directed that the applicants be released on bail on furnishing a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac Only) each with one surety each in the like amount to the satisfaction of the Trial Court/committal Court to appear before the Court on the dates given by the concerned Court.
This order shall be effective till the end of the trial, but in case of bail jump, it shall become ineffective.
