             WRIT PETITION No.16946 of 2021

ORDER :

This writ petition has been filed to declare the action of the respondents in not considering the petitioners under the scheme "YSR CHEYUTHA" though the petitioners are eligible, as illegal, arbitrary, violative of principles of natural justice and contrary to G.O.Ms.No.636, dated 12.06.2020, and in consequential relief, to direct the respondents to consider and include the names of the petitioners in the beneficiaries list and release the financial assistance to each of them under the said scheme.

Heard the learned counsel for the petitioners and the learned Government Pleader for Panchayat Raj appearing for the respondents No.1 and 3, Sri Ravi Teja Padiri, learned Standing Counsel appearing for the respondents No.2 and 4 and Sri V. Vinod K Reddy, learned Standing Counsel appearing for the respondents No.5 and 6. Perused the material available on record and with their consent, the writ petition is disposed of at the stage of admission.

3. Learned counsel for the petitioners submits that all the petitioners are residents of Molakalapudi Village, Chittamur Mandal, SPSR Nellore District, and they are having white ration card. The Government of Andhra 2 Pradesh introduced the scheme i.e., "YSR CHEYUTHA"

under the "Navaratnalu" scheme for granting financial assistance of Rs.18,750/- in four phases i.e., total of Rs.75,000/- to the women who are belonging to BC, SC, ST and Minority communities. The petitioners' submitted applications for financial assistance under the said scheme, but their names are not included in the beneficiaries list by the respondent No.6.

4. Learned counsel for the petitioners further submits that due to political pressure, the names of the petitioners are not included in the beneficiaries list though they fulfilled the eligibility criteria under the scheme.

Learned counsels appearing for the respondents submit that if the petitioners are fulfilled the eligibility criteria, not including their names in the beneficiaries list does not arise and once again they will verify the applications of the petitioners to know whether they have fulfilled their eligibility criteria under the scheme or not.

Having heard the submissions of both the counsels and upon perusal of the material available on record, in the opinion of this Court, it is appropriate to dispose of this writ petition without keeping this writ petition pending for years together by issuing certain directions to the petitioners and the respondents to meet the ends of justice. 3

7. Accordingly, the Writ Petition is disposed of with the following directions:

i) The respondents No.5 and 6 are directed to reconsider the applications of the petitioners to ascertain whether they fulfilled the eligibility criteria for financial assistance under the scheme "YSR CHEYUTHA" or not;
ii) The petitioners shall submit all the requisite documents to the respondent No.5 to prove their entitlement under the scheme within a period of one week from today;
iii) The respondent No.5 shall verify the said documents and include the names of the petitioners in the beneficiaries list, if they are fulfilled the eligibility criteria within one week thereafter;
iv) The respondent No.5 shall inform the reasons in writing to the concerned petitioner, if his/her case is not considered under proper acknowledgment within one week thereafter;
v) The remaining respondents are directed to make payments to the petitioners, who are included in the beneficiaries list by the respondent No.5 within a period of four (04) weeks from today.

There shall be no order as to costs.

As a sequel, all the pending miscellaneous applications shall stand closed.
