Section 69(1) in Karnataka Agricultural Produce Marketing Act 1966
(1)If at any time after a notification is issued under section 4 the market committee [or the Board] [Inserted by Act 35 of 1986 w.e.f.17.6.1986] or the State Government is of opinion that any land is needed for the purposes of this Act the State Government may proceed to acquire it under the provisions of the Land Acquisition Act 1894:Provided that once a proposal is made by the market committee [or the Board] [Inserted by Act 35 of 1986 w.e.f.17.6.1986] it shall not be withdrawn by it except for such reasons as may be approved by the State Government:[Provided further that if the local authority concerned is unable to provide land or other facilities for establishment or development of rural shandies the State Government may acquire land for that purpose.] [Inserted by Act 16 of 1991 w.e.f.1.8.1991]
