Section 219 in Tamil Nadu District Municipalities Act, 1920

219. Precaution in case of dangerous trees.

(1)If any tree or any branch of a tree or the fruit of any tree appears to the [executive authority] [These words were substituted for the word 'chairman' by section 17(1) of the Madras District Municipalities (Amendment) Act, 1933 (Madras Act XV of 1933).] to be likely to fall and thereby endanger any person or any structure, the [executive authority] [These words were substituted for the word 'chairman' by section 17(1) of the Madras District Municipalities (Amendment) Act, 1933 (Madras Act XV of 1933).] may, by notice, require the owner of the said tree to secure, lop or cut down the said tree so as to prevent any danger therefrom.
(2)If immediate action is necessary, the [executive authority] [These words were substituted for the word 'chairman' by section 17(1) of the Madras District Municipalities (Amendment) Act, 1933 (Madras Act XV of 1933).] shall himself, before giving such notice or before the period of such notice expires, secure, lop or cut down the said tree or remove the fruit thereof or fence off a part of any street or take such other temporary measures as he thinks fit to prevent danger, and the cost of so doing shall be recoverable from the owner of the tree in the manner provided in section 344.
