_____________________________________________________ Mansoor Ahmad Mir, Chief Justice, (Oral) The petitioner, by the medium of this Review Petition, has sought mercy on the grounds taken in the Review Petition.

2. It is averred in the petition that the petitioner is extremely poor and is not in a position to pay costs. It is apt to reproduce para 3 of the review petition herein.

"3.That the present petitioner files the present petition for review of the judgment dated 31.5.2016 to the extent of waiver of the imposition of costs, which are heavy and the petitioner who is a retiree will be subjected to considerable hardship in paying such a heavy costs."

3. The averments contained in para 3 supra have remained un-rebutted.

4. In the given circumstances, we deem it proper .

to modify the judgment in exercise of powers under Sections 151 and 152 of the Code of Civil Procedure and direct the petitioner to pay cost to the tune of Rs.10,000/-, instead of Rs.1,00,000/-. Ordered of accordingly. Let the cost be deposited within four weeks from today. This order shall form part of the rt judgment dated 31.5.2016 passed in CWP No. 364 of 2016.

5. Accordingly, the Review Petition is disposed of, alonwith pending applications, if any.
