The petitioner has filed the present petition challenging the inaction of the
respondents in not extending the benefit of Earned Leave of 120 days to the
petitioner.
sh Learned counsel for the petitioner submits that the case of the petitioner is e squarely covered by the order passed by this Court in the case of State of M.P. ad Vs. Smt. Shyama Bai passed in Writ Appeal No. 753/2010 and this order was further reviewed by the Division Bench in Review Petition No. 506/2012 decided on 21/07/2014.
Learned counsel for the petitioner further submits that for extending the Pr a benefit of aforesaid leave, the petitioner has already submitted a representation hy (Annexure P/3) to the respondent no.4 therefore, he prays that appropriate ad direction may be issued to respondent no.4 to consider and decide the said representation in the light of the order passed in W.A. No. 753/2010 as well as M the order passed in Review Petition No. 506/2012.
Learned Government Advocate submits that the suitable action shall be of taken in the matter within three months' time.
rt In view of the aforesaid, the writ petition is disposed of and the ou respondents are directed to decide the representation (Annexure P/3) filed by the petitioner in the light of the order passed in W.A. No. 753/2010 as well as the C order passed in Review Petition No. 506/2012 within three months' from the date of receipt of certified copy of this order. h ig C.C as per rules.
