2. Learned ASG further submitted that in each of the States, a specific and dedicated Nodal Officer has been nominated in every district of the States. In this regard, the list of various States/Union Territories nominating the Nodal Officers for each district whose details have also been uploaded on the Mission Vatsalya Portal have also been submitted before this Court. The nomination of the Nodal Officers for each district in each State and Union Territory shall be appended to this order as an Annexure.
3. However, we find that the Ministry of Home Affairs, Government of India has not yet appointed any dedicated Nodal Officer for the purpose of Mission Vatsalya and hence, officers may be nominated as dedicated Nodal Officer(s) whose details also may be uploaded in the TrackChild tab of the Mission Vatsalya Portal.
4. Since the Nodal Officer is to be appointed by the Ministry of Home Affairs, Government of India and in each of the States as well as Union Territories they have already been appointed, we direct that there shall be a consultation between the Nodal Officers of the Ministry of Home Affairs, Government of India with the Nodal Officers of each of the States and Union Territories for the purpose of collection of up-to-date statistics of the number of missing children and restoration of children to their parents/guardians or to the childcare homes, as the case 7 may be.
5. Thus, the Nodal Officers to be appointed in the Ministry of Home Affairs, Government of India shall in turn hold a consultation for the purpose of seeking from the Nodal Officer of every State and Union Territory, the statistics regarding missing children from 01.01.2020 onwards till 31.12.2025.
6. Further, the Nodal Officers of each State and Union territories referred to above shall also collate from the Director of Prosecution in each State/Union Territory, the statistics and details with regard to the prosecution of the cases in the matter of missing children and submit those details to the Nodal Officers to be appointed by the Central Government in the Ministry of Home Affairs.
7. The appointment of the Dedicated Nodal Officers in the Ministry of Home Affairs, Government of India shall be done within a period of three weeks from today so that the said Nodal Officers could have the consultation with the Nodal Officers referred to above in each State and Union Territory for seeking information, as noted above.
8. The said exercise shall be carried out within a period of six weeks.
9. We place on record our appreciation of the 8 coordination that has taken place for the nomination of the Nodal Officers in the States/Union Territories, who have further nominated the Nodal officers in each of the districts of the States and Union Territories.
10. Having regard to the aforesaid exercise to be carried out, we accept the submissions made by learned ASG to implead the Ministry of Women and Child Development represented by its Secretary as a respondent. Petitioner’s counsel to file amended memo of parties within a week’s time.
