RAKESH KUMAR JAIN, J. (ORAL)

This is a petition for grant of regular bail in a pending trial case registered vide FIR No.32 dated 21.02.2011, under Section 21/61/85 of the NDPS Act at Police Station Division No.7, Ludhiana, District Ludhiana.

The petitioner had earlier applied for bail vide CRM-M-12624-2011. At that time, it was observed by this Court that though the petitioner had claimed himself to be a Chemist but he could not produce the bills of the recovered drugs. While dismissing that bail application, the Court had found that it is not the pure drug content which is to be considered rather the entire mixture or solution with the drug content is to be considered in terms of the notification dated 18.11.2009.

The petitioner has now again filed the present bail application and has submitted that he has got the bills of the recovered drugs but at the same time, he has admitted that the said bills have not been supplied to the police at any point of time for the purpose of its investigation.

Keeping in view the facts and circumstances of the case, I do not find it to be a fit case for grant of bail. Hence, the present petition is hereby dismissed.
