1. The present application has been filed in CRL.REV.P. 690/2022, which is directed against the judgment dated 22nd October, 2019, passed by the Additional Sessions Judge, New Delhi, in Criminal Appeal No. 40/2019, acquitting the accused of the offence under Section 138 of the NI Act.

2. By way of this application, the accused seeks a direction to the Respondent to take back the stock lying at his residence within 30 days.

3. In the opinion of the Court, the relief sought is wholly beyond the scope of the present proceedings. If the parties have any dispute regarding the undisposed stock, the appropriate remedy is to approach the Civil Court for necessary relief. Such directions cannot be issued in proceedings arising under Section 138 of the NI Act.

4. The application is accordingly dismissed.

5. Both parties submit that there is a possibility of resolving the matter This is a digitally signed order.
