This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') by the petitioners- Accused to quash the proceedings against them in FIR No.512 of 2022 pending on the file of Station House Officer, Chaderghat Police Station, Hyderabad, registered for the offences punishable under Sections 403, 406, 420, 468 and 471 read with Section 34 of Indian Penal Code (for short "IPC").
2. Heard learned counsel for the petitioners - Accused and learned Additional Public Prosecutor for the respondent No.1 - State. Perused the material on record.
3. The 2nd respondent filed a complaint stating that their society which is M/s.Muslim Educational Social Cultural Organization (MESCO) consist of renowned doctors and formed for the purpose of service in Education, Medical field for poor etc., Crl.Petition No.328 of 2023 2
4. The crux of the allegation is that these petitioners while they were discharging their duties on behalf of the society indulging in withdrawing amounts illegally.
5. On perusal of the record, all the petitioners - Accused are aged above 65 years and even according to the complaint all the transactions can be verified with the banks and subject matter of documents.
6. In the said circumstances, this Court deems it appropriate to direct the Investigating Officer in FIR No.512 of 2022 pending on the file of Station House Officer, Chaderghat Police Station, Hyderabad, to conclude the investigation without taking any coercive steps against the petitioners - Accused. Further, the petitioners - Accused shall co-operate with the Investigating Officer as and when required for the purpose of investigation.
7. Accordingly, the Criminal Petition is disposed off.
Miscellaneous applications pending, if any, shall stand closed.
