ORDER
Shri S.C. Kaushik, the appellant has filed this appeal dated 21.12.2010 before the Commission against the Ministry of Finance, Department of Expenditure, New Delhi for not providing information to his RTI-request dated 25.10.2010. The matter came up for hearing on 25.08.2011. The appellant was present in person, whereas the respondents were represented by Smt. Renu Jain, Director and Shri Jagdish Chander, Deputy Secretary.
2. The appellant filed RTI-request dated 25.10.2010 seeking clarification pertaining to anomaly in respect grade pay of ex-cadre posts similar to Assistants of CSS cadre after implementation of 6th CPC. The CPIO vide letter No. 13(137)/2010-RTI dated 9.11.2010 informed the appellant that as per section 2(f) read with Section 2(j) of the RTI Act, the public authority can only provide information which is available in any material form. Since no information is available in material form, hence no information can be provided.
3. Aggrieved by reply of CPIO, the appellant preferred first-appeal before FAA 19.11.2010. The FAA vide order No. AA/240/10 dated 2.12.2010 upheld the reply of CPIO.

After hearing the parties and on perusal of relevant documents, the Commission observes that requisite information permissible under the RTI Act 2 Case No. CIC/SS/A/2011/000826 has been provided to the appellant. For redressal of his grievance, the appellant is advised to represent his case before the competent authority of his parent Department where is working The matter is accordingly disposed of with above observation.
