                direct the respondent to appoint the petitioner as Forest Guard with Driving
                Licence based on 66.14% mark secured by the petitioner under MBC/DNC.

                                                          ORDER

The petitioner has filed this writ petition to call for the records pertaining to the order of the respondent dated 20.06.2019 passed in Na. Ka. No.Oo.Mu.TNFUSRC/29323/2019, quash the same and to direct the respondent to appoint the petitioner as Forest Guard with Driving Licence based on 66.14% marks secured by the petitioner under MBC/DNC and for further orders.

In response to the notification issued by the respondent in Notification No.1/2018 for direct recruitment for the post of Forest Guards, the petitioner had applied for the same under General as well as MBC category. He attended the online examination. The petitioner's name has not been listed in the selection list under the General as well as MBC category. The petitioner's marks has been published and he came to know that he has secured 66.14%. Despite the cut-off marks for MBC category was 49.48%, the petitioner was not called for certificate verification and no appointment order was issued to him.

3. The learned Government Advocate (Forest) appearing for the respondent submitted that the cut-off marks for candidates belonging to MBC/DNC General is 69.46% and MBC/DNC PSTM category is 68.58%. As the petitioner has secured only 66.14%, he did not reach the zone of consideration. In the counter affidavit of the respondents, it has been admitted that the petitioner belongs to MBC/DNC category and he has secured 66.14%. Though it is stated that the marks secured by the petitioner is less than 68.58%, in the final cut-off marks published in the official website, it is seen that the cut-off marks for MBC/DNC category is only 49.48%. As the petitioner claims his entitlement only as per the cut-off marks published by the respondent in their website, the respondent has to clarify the same. Even in the impugned order dated 26.02.2019, it is only stated that the petitioner has not submitted the required documents for the post of Forest Guard with Driving License and hence he was not called for certificate verification. Since the required documents are not submitted by the petitioner, the website has not accepted petitioner's application and rejected. As the respondent has stated contradictory facts about the cut-off marks and the reasons for not calling the petitioner for certificate verification, I find the impugned order is liable to set aside. ________ https://www.mhc.tn.gov.in/judis ( Uploaded on: 05/03/2025 01:43:14 pm ) Page 3/5 W.P. 4. Accordingly, this writ petition is allowed and the impugned order of the respondent dated 20.06.2019 passed in Na. Ka. No.Oo.Mu.TNFUSRC/29323/2019, is set aside. The respondent is directed to consider the representation of the petitioner in the light of the observations made above and pass orders afresh within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, the connected writ miscellaneous petitions are closed.
