Per: Justice Shri M.G. Sewllkar, Member (3) MA No.288/202) filed by the applicants for Joint Petition is allowed.
2. 'his Original Application has been filed by the applicants for the relief bringing them under the caver of Old Pension Scheme.
3, Leamed counsel for the applicants has produced across the Bar DoPT OM dated 03° March, 2023 in which it is mentioned that where the Central Government civil employees who have been appointed against the posts or vacancies which were advertised/notified for recrultment/appointment prior to the date of Notification for National Pension System ie. 22 December, 2003 and are covered under the National Pession System on joining service on or after 01" January, 2004, may be given one time option to be covered under the CCS(@ension) Rules, 1972 (now 2021).
4. Learned counsel for the applicants points out that the applicants have given the option. He submits that this OA can be disposed of by giving direction to respondents to take a decision in accordance with the QM dated 03" March, 2023.
§. In view of this, the resp onde nis are directed to take a decision in respect of the option exercised by the applicants vide OM dated {5 tid No ISG 2F 03" March, 2023 expeditiously.
8 With these directions, the Origmal Application stands disposed of So costs.
