                                  ORDER

Information sought:

The Appellant filed an online RTI Application dated 07.12.2020 seeking information on the following two points:
"I did 3 year diploma in Computer Engineering after my 10th class and want to pursue my graduation in BCA (through lateral entry) in distance mode.
My questions are
1) Whether lateral entry (direct to 2nd year/3rd semester) in BCA (bachelor e of computer application) is valid or not as per UGC norms and regulation?
2) If I pursue my graduation in the same (BCA lateral entry) whether I will be eligible for government exams (where specified degree from UGC recognized university, as minimum qualification) for instance for UPSC CSE, CDS, SSC CGL etc. Many universities such as TNOU (Tamilnadu Open University) PTU (Punjab technical university), LPU (lovely professional university) and many more universities, have provision of lateral entry.

The CPIO vide online reply dated 18.02.2021, informed to the Appellant as under:

Being dissatisfied, the Appellant filed a First Appeal dated 14.01.2021, which has not been adjudicated by the First Appellate Authority as per available records Page 2 of 5 CIC/UGCOM/A/2021/607494 Grounds for Second Appeal:
The Appellant filed a Second Appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the Respondent. Appellant requested the Commission to direct the CPIO to provide complete information sought for.
Submissions made by Appellant and Respondent during Hearing:
The Appellant did not participate in the hearing despite being served the hearing notice.
The Respondent submitted that the contents of the instant RTI Application were clarificatory in nature, yet adequate information as available has been provided to the Appellant vide reply dated 18.02.2021.
The Commission queried the Respondent regarding the status of First Appeal to which the Respondent submitted the First Appeal has been adjudicated on 22.02.2021 wherein the First Appellate Authority has upheld the reply dated 18.02.2021. The contents of the above order dated 22.02.2021 are as under:

Decision:
Upon perusal of the facts on record as well as on the basis of the proceedings during the hearing, the Commission observes that though the instant RTI Application is clarificatory in nature, an adequate reply has been furnished to the Appellant and the Commission upholds the same. Moreover, the Appellant did not participate in the hearing to buttress her case. Hence, the Commission finds no further scope of intervention in the instant matter. With the above observations, the instant Second Appeal is disposed of. Copy of the decision be provided free of cost to the parties.
The Appeal, hereby, stands disposed of.
