                WRIT PETITION No.13149 of 2024
ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking following relief:

"...to pass an order, direction or Writ more particularly in the nature of Writ of Mandamus to direct Respondents more particularly Respondent Nos.2 & 4 to extend the cut-off date for completion of internship for a period of 15 days i.e. from 15.08.2024 to 31.08.2024 in their Information Bulletin-cum- Notification dated 16.04.2024 for the admission of NEET-PG 2024 and further direct the Respondent Nos.2 & 4 to accept the application of NEET-PG 2024 entrance test or otherwise it would amount to violation of Article 14, 19 & 21 of Constitution of India and pass such other and further orders, which this Hon'ble Court deems fit and proper in the circumstances of the case and in the interest of justice.."

2. The petitioners are pursuing their MBBS Degree in the respondent No.4-University. It is the case of the petitioners that the respondent No.4-University had issued circular No.700/Exams/KNRUHS/2023 dated 24.07.2023 postponing the schedule for Final MBBS Part-II Supplementary Examinations, which was scheduled to be conducted from 21.07.2023 onwards. It is further case of the petitioners that as per the Notification dated 16.04.2024 and Schedule of NEET-PG 2024, the cut-off date for completion of internship for eligibility to appear NEET-PG Examination 2024 is 2 15.08.2024. It is the case of the petitioners that they have to complete 12 months internship subsequent to the conclusion of final examinations conducted by the University. It is further case of the petitioners that due to rescheduling of Supplementary Exams to 04.08.2023 and 07.08.2023 from 21.07.2023 & 28.07.2023, their internship would be completed by 31.08.2024 falling short of 15 days from the cut- off date i.e, 15.08.2024.

3. The learned counsel for the petitioners placed reliance on the decision in Shikhar and another vs. National Board of Examination and others 1 and submitted that respondent No.2 is having power to condone the shortfall of minimum required internship experience to the petitioners.

In view of the above submissions, this Court without expressing any opinion with regard to the merits of the case, deems it appropriate to permit the petitioners to submit a representation to the respondent Nos.2 to 4 requesting to condone the shortfall of 15 days of internship experience to apply for NEET PG 2024 Exam. If such an application is made, 1 2022 SCC Online SC 425 3 the respondent Nos.2 to 4 are directed to examine the same by taking into consideration the career of the petitioners and pass appropriate orders, within a period of two (2) days from today. The learned counsel for the petitioners and the respondents are directed to communicate this order to the respondents, forthwith.

5. Accordingly, this Writ Petition is disposed of.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
