1. Shri N. D. Thombre, learned counsel for the petitioner submits that after full-fledged departmental proceedings, the petitioner was imposed the punishment of stoppage of one increment for a period of three years.

2. In the aforesaid backdrop, it is claimed that the suspension period ought to have been treated as on duty period and entitled to all the benefits. Support is sought to be taken from the judgments including the judgment of this Court in the matter of S.P. Naik vs. Board of Trustees, Mormugao Port Trust reported in 1999(3) Mh.L.J. 351.

3. Issue notice to the respondents, returnable in four weeks.

4. Ms N. P. Mehta, learned Additional Government Pleader waives service of notice for respondent Nos.1 to 4.

5. It is made clear that the copy of the writ petition be supplied to the office within a period of one week from today, failing which the writ petition shall stand dismissed without further reference to the Court.
