This writ petition has been filed, seeking issuance of a direction to the respondents to consider the petitioner's case for allotment of paddy and to decide his matter afresh as per order dated 16.11.2018, passed in CWP No. 27270 of 2018.

The petitioner by way of CWP No. 27270 of 2018 challenged order dated 09.10.2018 (Annexure P-5), wherein the petitioner had been declared to be a defaulter with immediate effect and declared ineligible for allotment until clearance from the FCI. The said writ petition was disposed of on 16.11.2018, with a direction to the concerned authority to take a decision afresh after affording an opportunity of hearing to the petitioner. As the needful was not done, present petition for allotment of the paddy, was 1 of 2 ::: Downloaded on - 23-02-2020 23:45:42 ::: CWP No. 33504 of 2019 2 filed.

It is submitted that during the pendency of this petition, order dated 29.11.2019, attached as Annexure P-15, with CM-1746-CWP of 2020, has been passed by District Allotment Committee-cum-Deputy Director (Field) Food and Supplies Department, Patiala Division, Patiala, deciding the petitioner's representation.

At this state, learned counsel for the petitioner, seeks to withdraw this petition with liberty to file afresh, challenging the said order dated 29.11.2019, as well.

Dismissed as withdrawn with the liberty as aforementioned.
