The matter is listed under the heading "Presentation of Plaint'' on the basis of the report of the Learned Master and Official Referee dated 15th January, 2025.
Counsel for the plaintiff submits that though part cause of action arose within the jurisdiction of this Court and part cause of action arose outside the jurisdiction of this Court but inadvertently the plaintiff has not prayed for leave under Clause 12 of the Letters Patent either in the prayer portion or in the concise statement.
Accordingly, the counsel for the plaintiff prays for leave to add prayer in the prayer portion of the plaintiff as well as in the concise statement and in the Writ of Summon with regard to leave under clause 12 of the Letters Patent.
In view of the submission made by the counsel for the plaintiff, leave is granted to the plaintiff to add the prayer in the prayer portion, concise statement and in the Writ of Summon for grant of leave under 2 Clause 12 of the Letters Patent within three days by putting the counter signature in the said portion after the amendment is carried out.
Let the matter appear for presentation of the plaint.
