Sir, I have a simple point regarding procedure. I know that Points of Order are not raised during Zero Hour. The Zero Hour has started. But we received the copy of the Resolution just a little while ago. It is written:
“SHRI AMIT SHAH to move the following Resolution:-
That the President of India has referred the Jammu and Kashmir Reorganisation Bill, 2019 to this House under the proviso to article 3 of the Constitution of India for its views…” Sir, it has not been the practice of this House ever to put a Resolution ahead of a Bill.
In our House, Bills are circulated in advance. Then, they are introduced, opposition to introduction is allowed and then the Bill is discussed. The Bill has not come to this House, it has not been circulated among Members, it is still being debated in the other House, the Home Minister came and presented the Resolution. Now, at the time he presented the Resolution, you took a vote and said, ‘those in favour may say aye’. We wanted a division, but you did not allow a division for whatever reason. Whenever there is a Resolution, you ask for ‘ayes’ and ‘noes’.

रक्षा मंत्री (श्री राजनाथ सिंह) : अध्यक्ष महोदय, श्री अंधीर रंजन चौधरी जी,श्री बालू जी और प्रो. सौगत राय जी इस सदन के बहुत ही पुराने और बहुत ही वरिष्ठ सदस्य हैं । जबकि चेयर के द्वारा यह व्यवस्था दे दी गई थी कि शून्य काल में कोई भी पाइंट ऑफ आर्डर मूव नहीं किया जा सकता है, फिर भी इन लोगों ने पाइंट ऑफ आर्डर रेज़ करने की कोशिश की है । आपने अपनी सहनशीलता का परिचय देकर इनको यह बोलने की इजाजत दी है,लेकिन इन लोगों ने उसका भी आदर नहीं किया है ।…(व्यवधान) जबकि रिज़ॉल्यूशन पेश किया जा सकता है । गृह मंत्री जी ने नियमों के अनुसार ही रिज़ॉल्यूशन को इस सदन में पेश किया है । मैं इस भारत के संविधान के पार्ट 1 के इस क्लॉज़ 3 की ओर भी आपका ध्यान आकर्षित कराना चाहूंगा कि-
“Parliament may by law form a new State by separation of territory from any State or by uniting two or more States or parts of States or by uniting any territory to a part of any State, increase the area of any State, diminish the area of any State, alter the boundaries of any State, alter the name of any State, provided that no Bill for the purpose shall be introduced in either House of Parliament except on the recommendation of the President and unless, where the proposal contained in the Bill affects the area, boundaries of any State or States…” अध्यक्ष जी, हमारा इतना ही कहना है कि गृह मंत्री जी ने इस सदन में रिज़ॉल्यूशन प्रस्तुत कर दिया है ।…(व्यवधान)
गृह मंत्री जी ने यह आश्वस्त किया है कि कल जब इस पर चर्चा होगी, जो भी सवाल प्रतिपक्ष के द्वारा खड़े किए जाएँगे, उनका वे विधिवत जवाब देंगे । धैर्यपूर्वक सब की बातों को सुनने के बाद उसका विधिवत जवाब देंगे तो मैं समझता हूँ कि वाक आउट करने का ओवैसी साहब कोई औचित्य नहीं है ।

संसदीय कार्य मंत्रालय में राज्य मंत्री तथा भारी उद्योग और लोक उद्यम मंत्रालय में राज्य मंत्री (श्री अर्जुन राम मेघवाल): अध्यक्ष महोदय, आइटम नम्बर 8, जो माननीय रवि शंकर जी के नाम के आगे अंकित है- उच्चतम न्यायालय (न्यायाधीश संख्या) संशोधन विधेयक, 2019. मैं रिक्वेस्ट करूँगा कि हमारे कानून मंत्री उपलब्ध हैं, यह बिल ले लिया जाए ।
