Heard the learned Advocates appearing on behalf of the parties. Perused the case diary.

This is a case, where from the possession of the petitioner, 10 Kgs. of Ganja was recovered.

The petitioner is in custody for 210 days but till date, no charge has been framed. He has no criminal antecedent.

Now, considering the petitioner's length of detention in custody and when no case is made out from the side of the State showing that further custodial detention of the petitioner is necessary, we allow his prayer for bail.

Let the petitioner be released on bail upon furnishing a bond of Rs.60,000/- with two sureties of Rs.30,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Judge, under the N.D.P.S. Act, Barrackpore subject to the condition that after release, the petitioner shall not enter within the jurisdiction of 2 Khardah Police Station, except for the purpose of attending the court's proceedings and before release, he shall furnish his address, where he will reside after release, to the court below and also to the I.O. of the case and shall report to the officer-in-charge of the concerned police station, where he shall reside after his release, on every alternate day, until further orders.

The application for bail is, thus, disposed of.
