HON'BLE MR. JUSTICE BIRENDRA KUMAR Order 18/05/2022 The petitioner has sought for quashment of criminal case No.41/2022 titled as Union of India Versus M/s Dipty Lal Judge Mal Pvt. Ltd. and Others pending before learned Chief Metropolitan Magistrate (Economic Offences), Jaipur Metropolitan II for the offences under Sections 9 and 9AA of the Central Excise Act, 1944 read with Section 174 of the Goods and Service Tax Act, 2017.
Learned counsel for the petitioners submits that the different anomalies in non-compliance of mandate of law is there. Learned court below has issued warrant of arrest against the petitioners.
Let notice should go to the respondent through both processes.
Requisites be filed within ten days. Considering the nature of offence alleged, it is directed that the petitioners shall not be arrested in the aforesaid case, till further orders.
