         Heard learned counsel for the parties.

         An Interlocutory Application No. 1957 of 2012 has been filed in this writ

   petition by the petitioner praying therein that services of Shri R..C. Choudhary,

   Superintendent of Police, Central Bureau of Investigations, who is to retire on

   31.07.2012

from his service, may be extended in view of the pendency of various Fodder Scam Cases (AHD cases) pending in different C.B.I. Courts at Ranchi.

The petitioner stated in the application that continuation of service of Shri R.C. Choudhary, Superintendent of Police, Central Bureau of Investigations, is indispensable because he is now an important witness in the various matters and he was involved in the investigations of those cases.

The application, on the face of it, is absolutely frivolous and has been filed without any reason as no one can be indispensable for any institution. Therefore, I.A. No.1957 of 2012 is dismissed.

We perused the progress report of AHD Scam Cases submitted by C.B.I., pending in the Court of Special Judge Nos.-II, IV, V and VII. It appears that from 01.04.2012 to 23.07.2012, these Courts have recorded statement of the witnesses ranging from one to nine witnesses only. The progress is not satisfactory at all. In a period of three months, in one case, nine witnesses were examined and in other matters also, only one, two or three witnesses were examined. This Court is not happy with the progress at all.

The Courts below are directed to proceed expeditiously and C.B.I. shall ensure attendance of the witnesses so that they may be examined. In a case where there are witnesses, who can remain present on one day, the matter may be taken-up on the basis of day-to-day hearing of the matter.

Now, the progress report may be submitted by the C.B.I. on 25.09.2012. A copy of this order be sent to the Courts of Special Judge Nos. II, IV, V and VII.
