2. All these petitions are the offshoots of the decision of the Apex Court in State of Tamil Nadu represented by its Secretary, Home, Prohibition and Excise Department and others...Versus...K. Balu and another, reported in (2017) 2 SCC 281 imposing restriction for opening or running of liquor shops visible from a National or State highway, directly accessible from National or State highway and situated within a distance of 500 meters of the outer edge of the National or State highway or of a service lane along the highway. The decision was rendered by the Apex Court on 15 th December, 2016. 3. Keeping in view the aforesaid clarifications issued by the Apex Court, the State Government has issued Circular dated 31st March, 2018 laying down the parameters in respect of grant or renewal of liquor licences. The said Circular was further clarified on 12th April, 2018.
4. In the light of the clarifications issued by the Apex Court referred to above and the Circular issued by the State Government along with its clarifications, each and every case is required to be examined by the Competent Authority, i.e., Superintendent of State Excise of the concerned District, who can go into all the questions including the one, as to whether the shops are located or to be located on the National highway or State highway, local bodies and Municipal areas, proximity of distance etc., which require factual aspect to be dealt with. Hence, all these matters can be disposed of with a direction to the Competent Authority, which is the Superintendent of State Excise of the Region concerned, to adjudicate and take decision in the light of clarifications so issued by the Apex Court as well as by the State Government. ::: Uploaded on - 22/11/2019 ::: Downloaded on - 24/04/2020 06:29:21 :::

5. In view of above, all these writ petitions are disposed of by an order as under :
(i) The petitioners are at liberty to make appropriate representation to the concerned Superintendent of State Excise within a period of fifteen days from today, either for grant or renewal of licences for continuation of liquor shops.
(ii) Keeping in view the law laid down by the Apex Court as clarified from time to time and the Government Circulars and clarifications issued thereafter, appropriate decision be taken, obviously after granting hearing to the parties concerned, in each matter, in accordance with law, within a period of three months from the date of making of representation.
(iii) It shall be open for the parties, if at all aggrieved by such decision, to approach this Court for redressal of their grievances.

6. Rule is made absolute in the aforesaid terms. No order as to costs.
