1. The issue relates to Modvat. Issue with reference to maintainability of appeals in respect of Modvat credit has already been considered by us as per our earlier Order No. 249-299/2001, dt 27.2.2001, following the ratio of the decision, this appeal is dismissed as not maintainable.
