(6)Any person who runs a tutorial institution in contravention of clause (b) of sub-section (1) or who establishes and manages a tutorial institution without obtaining a registration certificate under sub-section (2) or who after the registration certificate issued to him, under that sub-section having been cancelled continues to run such institution, shall be punished 40[with imprisonment for a term which shall not be less than six months but which may extend to one year or with fine which may extend to one thousand rupees or with both:]Provided that for a second or any subsequent offence under this section, he shall be punished with imprisonment for a term [which shall not be less than one year but which may extend to two years or with fine which may extend to five thousand rupees or with both:] [Substituted by Act No.27 of 1987.][Provided further that the Court convicting a person under this section shall also order the closure of the tutorial institution with respect to which the offence is committed.] [Second proviso to sub-section (6) added by Act No.27 of 1987.]
