The Appellant was not present in spite of notice.

The Appellant did not turn up for the hearing in spite of notice. The Respondents were present and made their submissions.
2. The Appellant had referred to a large number of past correspondences and had requested the Secretary of the UPSC to provide him with the desired information relating to those. The CPIO had informed him about the marks he CIC/SM/A/2011/002037 secured in the Civil Service (Preliminary) Examination 2005. The Appellate Authority had endorsed the information provided by the CPIO.
3. In his second appeal, the Appellant seems to have questioned the marks indicated by the CPIO. He is interested to get the actual marks he was awarded thereby implying that he does not believe the marks indicated by the CPIO to be his actual marks. The UPSC is known to follow the practice of scaling the marks. Therefore, in the present case, it appears that the Appellant wants to know the marks he received prior to the scaling and he calls that as actual marks. If there is any such marks, it should now be disclosed to him in terms of the decision of the Delhi High Court in the LPA number to 29/2011 and WP(C) number 3316/2011. The respondent, however, informed us that all the records of this particular examination of 2005 including the marks had been weeded out as per the policy of the UPSC. While appreciating that, we think it is possible that the relevant records on the present Appellant might have been preserved due to the pendency of the RTI appeal. In case, it is still preserved, the Appellant must get it. Therefore, we direct the CPIO to provide such marks to the Appellant, if still available, within 10 working days of receiving this order. If the relevant records are not available any longer, the CPIO must also inform the Appellant suitably.
4. The appeal is disposed off accordingly.
5. Copies of this order be given free of cost to the parties.
