Author: Arindam Mukherjee

Bench: Arindam Mukherjee

17.05.2022 IN THE HIGH COURT AT CALCUTTA
 Sl. No.36 CONSTITUTIONAL WRIT JURISDICTION
    (PP) APPELLATE SIDE

                              WPA 3965 of 2022

                             Dr. Tirthendu Biswas
                                     Vs.
The State of West Bengal & Ors.

                 Mr. Prantik Ghosh,
                 Mr. Siddhartha Sarkar
                                                ....for the petitioner.

                 Mr. Tapan Kumar Mukherjee, AGP,
                 Ms. Sangeeta Roy
                                              ...for the State.

The petitioner is registered Homeopathic medical

practitioner and claims to be serving as Medical

Officer under Rashtriya Bal Swasthya Karyakram (in

short, RBSK) on contractual basis with a consolidated

monthly remuneration of Rs.25,000/-. The petitioner

says that by virtue of a Notification dated 1st April,

2020, the petitioner is entitled to an additional

financial assistance of Rs.1,00,000/- being an

employee on contractual basis in Health & Family

Welfare Department, Government of West Bengal due

to his assignment to serve Covid-19 patients during

pandemic. The petitioner had made a claim for such

additional sum through the office of the Chief Medical

Officer of Health, Berhampore (Sadar), Murshidabad.

The petitioner says that such application has neither
                       2

been processed nor being disposed by the concerned

authority.

In such circumstances, the respondents were

directed to take a decision as to whether the financial assistance of Rs.1,00,000/- as claimed by the petitioner was available to him or not. The status report signed by the Senior Deputy Secretary to Health & Family Welfare Department filed in Court today is retained with the record. On behalf of the State, it is submitted that the financial assistance of Rs.1,00,000/- had been sanctioned in favour of the petitioner, but the amount could not be credited in the bank account of the petitioner due to failure in transaction. On enquiry it reveals that due to mismatch of IFS Code of the bank, the particulars whereof was given by the petitioner the transaction failed. It further appears from the record produced by the State that the petitioner had made over a cancelled cheque of United Bank of India (in short UBI) at Berhampore Branch, West Bengal. UBI in the meantime has merged with Punjab National Bank (in short PNB) and as such, the old IFS Code of the particular branch of UBI had become non-operational for which the transaction appears to have failed. 3 The petitioner has now provided the IFS Code of PNB, Berhampore (WB) (Murshidabad) West Bengal Branch. This has been done only on 10th may, 2022 and as such, it is expected that the money will be credited in the petitioner's bank account within a short while.

Considering such submission, let this matter be adjourned till 20th June, 2022 to ascertain whether the payment is made in the meantime.
